Once someone receives PHI on an individual, they can considered a covered entity. Low was provided PHI by someone at the facility, a clear violation, that Lofton had the Surgical procedure. Low and ESPN was protecting 1) his relationship at Tennessee & thruout the SEC & 2) a source that had provided him the information.I'm an attorney so I know what HIPAA is. I also know that it only applies to Covered Entities (healthcare providers, hospitals, insurance companies, etc.). Journalists are not Covered Entities under HIPAA. So unless Chris Low has a medical license that I don't know about, he is free to report on medical information. He did not do so because he chose not to, not because he is prevented by law. Most would not have chosen to withhold a story like that.
John Majors : “we want your money but we don’t need your 2cents worth”The program's financial statement and on-field results are the transparency. You can either buy tix/donate or not, your choice. Now that revenue-sharing has been adopted, you get to see that, too.
What you don't get to see are financial arrangements between private entities and players; that's NIL. You can grouse about it, but you may as well sky-yell. It's none of your business and never will be.
False.Once someone receives PHI on an individual, they can considered a covered entity. Low was provided PHI by someone at the facility, a clear violation, that Lofton had the Surgical procedure. Uhhhhh….That is for people and companies in the medical profession. There’s a little law called HIPAA that protects your private health information (PHI) from being made public unless you sign a document allowing that health provider to share it. It’s part of the mountains of paperwork you sign when you go to the Dr or Hospital. Every party that receives PHI must have that document before they share your PHI. The penalties are severe. Lofton would have had grounds to sue & ESPN would have had no defense unless Lofton agreed to sign allowing them to release it.
HIPAA has numerous restrictions but one of these primary reasons for the law is to protect our Private Health Information being disclosed without our consent.
100% false. Per law, the legal definition includes healthcare providers, health insurers, and healthcare clearinghouses.Once someone receives PHI on an individual, they can considered a covered entity. I work in medical marketing. I am not a licensed anything in healthcare. I am privy to patient health information routinely. I have signed document ms that state that I am not allowed to disclose patient information under penalty of law. Nor can a medical office administrator, janitor, whomever. If I so much as have my computer screen on with PHI and someone outside who is not authorized to see it is exposed to it, I have to disclose this to the patient or else I am in violation of the law.False.
But at this point, you know that. You’re simply dug in.
Scroll up and read the entire conversation. I introduced the term Covered Entity to this discussion (your phrasing of, “I fall under what's called a covered entity” indicates that you missed that fact and feel you are introducing me to the term).I work in medical marketing. I fall under what's called a covered entity. And so is everyone else who is privy to PHi.
What is your name so I can know this if I'm ever in need of legal counsel.
