some of the people have a very strong case but some are clearly in it for the money. The venue failed a bunch of people

considering what they're being offered by way of restitution, they should unbunch their panties.

Based on info I heard on the radio, the NFL has offered to pay three times what they paid for the tickets, and an all expense(Plane fair, hotel etc) trip to any one future Super Bowl they choose to go to. What else should they do?

It really excites me that my tax dollar is being wasted on such crap. People think that anytime something bad happens in their life that it warrants a lawsuit.....sometimes **** just happens. Sorry, I think that these people see an opportunity to get at the deep pockets of the NFL, Cowboys and JJ. It's the American way.

so the money they spent on plane tickets and hotels for this trip is an expense they should just absorb even though they did everything right?

and the future SB sounds nice but please tell me how anyone can guarantee their team will return to the SB. I doubt most just went for the SB experience but rather went to support a certain team

How is this being done with your tax dollars? The NFL messed up. The Cowboys messed up. Telling people to bend over and accept it isn't the best course of action.

for the ones suing because the seats weren't good enough I would agree. I don't agree with the ones whose seats were not there (even though they had a ticket) because of a failure of the venue

I assume it will go to court. Doesn't that cost the American tax payer? At least in time, when the courts could be ruling on something more pertinent to real life.

And the offer the NFL is giving isn't exactly telling someone to bend over.

if this is your stand on taxpayer waste then there are about 10,000 other things that are higher. The NFL is saying they they screwed up but around $800 should cover it. You're right, sounds like a sweet deal

I believe it is allot more money than that(The radio said the tickets averaged 2400, which translates into $7200 just for the tickets. I believe that would cover all the travel expenses....Not to mention a free trip to a future Superbowl. Hey the world stinks so less just add one more stupid lawsuit...just what we need.

please tell me the next SB that will include wither the Packers or the Steelers. I will make a bunch of money with that info. Not to mention I find it pretty amazing that they'll have 1000 seats available 2 weeks before the big game to uphold their promise

I am a Saints fan, but that does not mean I would only go to a SB if they were in it. I doubt all 1000 people would chose the same SB.

They're paying 3 times face value, which likely has nothing to do with actual ticket cost.

NFL will get their lunch handed to them here and will likely settle at a much larger number than the pathetic effort they threw out there.

And there lies the problem, it won't just compensate them it will turn into a money making proposition. I don't mind people being compensated, but I guess they will tact on Big $'s for that mental anguish. birgits_giggle: Those poor people:cray::cray:

I honestly can't say I would behave differently. For example, if I had flown out to Tempe in Jan 99 with a ticket in hand, stayed 3-4 nights in a hotel and found out my ticket was no good because Sun Devil forgot to get clearance for my seat then heads would have rolled. And if I had settled for their "any future NC game you want to attend" ploy I would sadly still be holding that voucher.

Agreed. I don't feel sorry for the fan who went because it's the super bowl, but if cal was in the rose bowl or something and i had to watch the game on a tv after paying $2,400 i'd be really pissed.

I would be pretty pissed if the Skins went to the SB and my ticket was bunk, but put a zero behind that ticket price and I would settle.

The liability issues are whether Texas recognizes any sort of cause of action for detrimental reliance on the contract of the ticket and whether, if it does, the damages include your ancillary costs.

For example, do you just get back the price of the ticket (regardless of what you paid for it) because that is the value received by the NFL? The case to be made for that is that they have no way in advance to anticipate exactly what you would spend on the secondary market for the ticket and definitely no way to know in advance that you'd spend $5,000 in airfare and hotel accommodations, meals, etc.

On the other hand, the patrons relied on the ticket and it really becomes more of a negligence issue, i.e. that the NFL knew a week beforehand that the seats would not be ready and so they had a duty to put out a warning to holders of those particular seats such that, if they breached that duty, then the ticketholders should be compensated their out of pocket expenses plus something for inconvenience, which in this case is not huge but is going to be worth something.

Not to mention that I'd wager dollars to doughnuts that there is some sort of disclaimer on the back of each of those tickets. Maybe an arbitration clause, too.

I'm not sure I would sue but the offer from the NFL is weak. If I'm a Packer or Steeler fan that put a lot into going to the game for which I had a guaranteed ticket and found that the venue could not deliver, I would expect to be made whole. A future Superbowl is not what I would consider being made whole.
