I know conservatives tend to like the citizens united ruling but despise the ACA ruling so the question is if you had to choose between both passing judicial muster like they did or both fail which would you choose?

It's ultimately the Supreme Court's duty to find any law constitutional if it can. I disagree with Robert's ruling on the ACA, but I can accept it on the grounds that he found a way to declare it constitutional.

There's nothing wrong with CU, so I went with #1.

one important difference is that CU says what people can do and ACA says what the government can make people do.

that is a material difference and I'll err on the side of more individual vs less individual freedom.
