Gonzales aide to invoke Fifth Amendment - Politics - MSNBC.com

WASHINGTON - Monica Goodling, a Justice Department official involved in the firings of federal prosecutors, will refuse to answer questions at upcoming Senate hearings, citing Fifth Amendment protection against self-incrimination, her lawyer said Monday.

"The potential for legal jeopardy for Ms. Goodling from even her most truthful and accurate testimony under these circumstances is very real," said the lawyer, John Dowd.

More constitutional follies:

President can constitutionally fire U.S. Attorneys
Congress can constitutionally hold hearings about firings
Witnesess can constitutionally take the 5th when questioned by Congress.

The founders explicitly made the right to silence the 5th amendment - right up their with the other first 10.

If silence is the last bastion of the scoundrel, the founders made damn sure it was a spelled out right to be such.

Here's some comments from Dick Durbin that show why this is a fishing expedition --

t's not just a matter of firing -- but who was not asked to go, as well. If and when Rove is sworn in as a witness, Durbin said it would be "reasonable" to "go beyond the eight who were dismissed" and ask about his relationship with those who were retained, whether any political pressure was put on U.S. attorneys who did not lose their jobs. Added Durbin, "What else was Karl Rove doing when it came to other activities, departments of the government?"

Sounds like a pretty open-ended inquiry to me.
