In need of advice

I have always had my kids, landen (8), Lexie (7), and Laylyn (5). Never married their mom but when we split up when Laylyn was 2 months old, she told the cops to let me take the kids. She parties and rarely sees her kids for 5 years. She would go months without seeing or speaking to them. When she did want to take them for a few days, I always let her. 2 years ago I moved out of the town I had always lived in and the kids began all hitting school age. They have had a life he'd for 2 years with one weekend a month visits to their moms. Their mom has had at least 5 different residences on the last year and more in the last 2. Some of the places she lived were with boyfriends. The kids would come home telling us about her new boyfriend. One time when she was asleep, the oldest was trying to open food with a knife and had to get stitches. We had to meet her at the hospital to take him home. She had 3 cp's cases against her for her filthy house and maggots in laylyns bottle. I remember picking them up one day and Laylyn had feces crusted in her diaper and drenched in sweat because their mom didn't have air conditioning. The mom has had several run ins with the law including DWI. Currently she doesn't have a car or a job and lives with her mother. She abisedtfood stamps by constantly receiving benefits but not allowing the food to go with the kids. Sold the food stamps. And wouldn't allow me to have access to their doctor or Medicaid information. Lexie had to get a few shots to start school and Laylyn had to have them ALL. It took my wife and me a year to get Laylyn caught up so she could attend school. The whole time she had them on medicade they never saw a dentist. The past 2 years we have had them on medicade we were able to bring them to the dentist and fix their teeth. A week and a half ago she called me gripping that landen was at the park play alone. She called the cops and the cops said it was fine we can see the park, we were all outside back and forth all day and we live in a gates community. She sent her mom over to get the kids and they wanted to go so bad and I have never not allowed them to go. So they went. She lied and said that she would bring them to school Monday. She never did . she tried to withdrawal them from school and they wouldn't let her. We don't have any court orders at all. They have missed an entire week of school and landen has dilexia and already repeated kindergarten. Laylyn had an appointment to get glasses and her mom doesn't even know she needs them. The worst part.. She wont let me talk to them at all. I call. I text. I leave voice mails. She claims she filed papers and I should be getting served soon, but I can't afford a lawyer. I was hoping she did file so I could get in a court room asap with a lawyer but I didn't realize I have absolutely no one to help me hire one. My case is strong. She can't just rip my childrent from their home unexpected or explained and then not let me talk to them. If she is granted cusody and child support, she will bring the kids back so I'll be taking care of them and paying child support. In almost 9 years she has not been able to be a real mother. Kids get in the way of her partying. She can't wake up and bring them to school everyday and help them with homework everyday. Just a month ago she had to bring them home because grandmother and husband were fighting and on the verge of a dicorce. There is a major hole in my heart and in my house.

Sorry if this is not the place for this but i dont know what to do

you should have the court/ police etc. documents on all her run ins you described, if not you will lose whether you have a lawyer or not -- try and see a family counselor that can guide you through this, would be cheaper than a lawyer - the counselor can document everything you have listed and alot of them can steer you to a decent child custody lawyer - also go online and get the background report on the mother (arrests, etc) i think it costs like 12 bucks or so

like yankee said, you need an attorney and just set your expectations that it's going to take months to resolve
you need to document everything, around where they've lived, when they visited their mom, what she's contributed etc....just start listing it chronologically and give it to the attorney when you meet with them

Yep. Look around for legal services for folks with limited income, if nothing else they might help get you aimed in the right direction.

Absolutely. Surely DFACS could point him in the right direction if nothing else. Got to take care of this to avoid ongoing problems.

I would get the truancy officer involved and on my side.

Call a lawyer for cosultation. Some lawyers will do a one time consultation for free.

Go to the court house and file for emergency temporary custody and that will get you in front of the juvenile judge. I would do it where you live since they have been in your custody.

Have you tried filing kidnapping charges ? I know there isn't a set custody, but she is keeping the kids out of school.

I would exhaust all avenues.

Would the kids side with you in a hearing ?

I am in texas. I have talked to my local legal aid office and have a consultation next week. I have tried the police and dfacs every one has said to hire attorney.

As far as thebkids siding with me in court I'm not sure given their age. Seems the grass is always greener with the parent who is not around. They have never livedvwith her without me living there, so I'm sure in their minds its exciting to live with mom. My mother tried this with me when I was my sons age and all I wanted was to go back with my father.

My mother tried this with me when I was my sons age and all I wanted was to go back with my father.

with her arrest record and sorrid living environment - it wont matter who they side with at those ages - its up to the judge

Hindsight is always 20/20 but OP should have filed abandonment charges against her years ago.

I think he could file kidnapping charges now. He has proof as their primary care giver.

(I'd put a pound of pot in her car and call the cops)

The school administration can have the kids picked up and brought to school as they are truant because of her....when that happens, be there to take them back........the school is your best resource until you can get an attorney.......prayers your way

File a complaint with Texas Child Protective Sevices. I am not sure of Texas Law but try to get it classified as a "P-1" - top priority with potential immediate danger to the children. In Tennessee cases are classified as p-1 p-2 or p-3.

i want to thank every on who has taken time to read and reply. this is a very dark time for me and its nice to know there are people out there who care.
