she is innocent until proven guilty.
if what the police are saying is true, she mustve been really intoxicated.

the only way someone at .08 plows into a parade is if they have a pre-existing condition, are combining alcohol and another drug, or have a heart attack/aneurysm.

That's what she will face. She should face murder charges.

Murder requires intent. That's a common thing that people don't understand. However, in TN, you can be charged with vehicular homicide involving alcohol. It is the same class as second degree murder.

And yes, I have driven after drinking before. I did several times when I was younger. I did it voluntarily and knew the risks associated with it. If I were to kill someone, I would have faced the consequences.

I don't create the laws. Common law element of intent has been around for years and years. Some states may have maximum penalties of a life sentence. TN does not. While I know it's a hot topic, the act of intoxicated homicide is not quite on the same level as premeditated murder. And please don't take this as me being light on it as both are horrible and despicable. But it's just the legal interpretation.

If that's the case then so should people talking/texting on phones, reaching for pacifiers, looking for something they dropped, falling asleep.

70% of all traffic fatalities are caused by sober drivers. You're more than twice as likely to be killed by a sober person on the roadways. Why should only drunk drivers be subjected to death or life in prison?

Because the drunk driver took a life during the commission of a crime.

Just did some recon. Oklahoma has some surprisingly lenient laws on manslaughter.

I lived in Wyoming for a spell. Police didnt aggressively pursue DUI convictions out West, i guess they figured youd either kill yourself, a cow, or a fencepost?!

I think we're all looking at this based on TN statutes. If convicted of first degree manslaughter acc to OK law she's looking at a MINIMUM of four years. If Negligent Homicide, 0-1 years.

Crazy, Tennessee has a sentence per death of 2-60 years.

i hope they try her on second degree murder charges. it would be impossible to establish intent. but, those laws are pathetic.
