Legal/insurance question.

I know we have a few legal eagles on here and at least one insurance professional.
A few days ago, I was coming home from the dentist.While sitting in my car, parked at the red light, I glanced in my rear view mirror and see a huge concrete truck barreling down on me.He was not going to stop.The speed limit on the road is 50, so I'm not sure how fast he was going.While the light was still red I tried in vain to pull out of his way, thank goodness I was able to pull up and off to the left enough to where he was able to cut a hard right with his steering wheel and clip me in the back end of the passenger side of my Mercury Grand Marquis.It is probably totaled.I am awaiting the call from the his adjuster.Neither of us were injured but if I hadn't been watching I probably wouldn't be making this post.My air bag did not deploy.I had no pain even though I have had back surgery.8 cop cars,fire engine,ambulance, and it was weird bcause they sent the EMS guys over to check out the guy in the concrete truck (full of concrete).Do you guys think they will be more than happy to give me a generous offer since there not looking at a fatality here or are they going to give me the run around.So far they have been very cooperative.Of course I haven't signed anything.I will contact an attorney if needed.But is there something I can say to help me obtain a better settlement (just in case)?Thanks!

Well, you certainly have one factor in your favor. It appears that liability will not be an issue. Given that, I would think the insurance company won't be terribly difficult to deal with. Just be sure to get documentation for all losses and costs associated with the accident. By the nature of what they do, the insurance company will give a little runaround. However, I think you should have little problem.

I thought airbags deploy when there is a front impact.

Sounds like a pretty cut and dried case to me. These kinds of claims usually aren't all that big a deal and the insurance company will want to get this handled and closed as quickly as possible. I doubt you'll need to get an attorney involved.

Depending on how new your vehicle is . . . One thing you may be entitled to that people sometimes neglect to ask about is reimbursement for "Diminished Value" (the decrease in your vehicle's value due to the fact that it has now been involved in an accident.) It may not amount to much, but you might want to ask about it.

As an insurance professional, these names make my face pucker involuntarily.

Thanks guys.I'll remember the advice.USAF_VOL, I'm not sure how that air bag deployment works.I know I would have busted my head on the wheel.I had glass in my hair from the back windshield exploding.

Let me say this. If the offender has State Farm, You are in great shape. They are worth what you pay. Wish I'd never left them. In 1998, I was travelling south on I-85 from SC into GA. I crested a hill that was at traffic stand-still from the 7th accident that day up at the next hill. Travelling at about 50 mph at the time as I was slowing for some reason, I leaned the meaning of hitting a brick wall. I was not buckeled and fortunately remained in my seat.. But, I did demolish the 2 cars in front of me, as well as my Toyota 4x4. State Farm immediately tried to replace one vehicle as they wer on vacation from Canada, but they opted to take a rental and re-purchase cheaper in Canada on their return. Sent me cards and all. Great folks. The indirectly demolished vehicle was promptly replaced as well. When, this coupled sued 3 days before the statute expired, as their son was a lawyer, and the mother was so distraught those 3 years rom being 2 cars up in line, State Farm handled it wonderfully. They supplied the law firm, spent good time on investigation, took pics riding down the interstate to see what I could see, etc. Case awarded for only std. amount covered by insurance.

Moral: A reputable company will be fair, and there is seldom a need for a lawyer or lawsuit. That is a privaledge we abuse. It all depends on the carrier of the other driver.

And ken nugent just looks really shadey.

Glad you made it out alive. Nothing worse than seeing someone about to plow you from the rear.

Especially when it's tidwell with his rohypnol.
