CAMDEN, N.J. (AP) -- Wal-Mart is being sued for $1 million by a man who claims he was traumatized by a racist comment made over an intercom at a southern New Jersey store two years ago.


Donnell Battie, of Winslow, accuses Wal-Mart of being negligent in failing to control access to the store's intercom, which was used to broadcast an announcement ordering all black people to leave the Washington Township store. A 16-year-old boy was arrested days later and charged with harassment and bias intimidation.


Wal-Mart spokesman Greg Rossiter tells the Courier-Post (http://on.cpsj.com/KkdIUG ) the firm has apologized and has worked to prevent it from happening again.


Battie claims he has needed medical care due to the March 2010 comment. He says it caused him "severe and disabling emotional and psychological harm."

Seriously, this is what we've become? The American courts have become a better investment than the lottery

actually what I assume is that the judge will not laugh in this man's face and forcibly remove him from the courtroom like he should and then Walmart will be forced to settle to save money.

Hopefully it will get dismissed. If not, it's an excellent candidate for summary judgement, to save Walmart legal fees, so they don't have to settle, as pj said. Then, the man can be awarded exactly what he is rightfully owed, without a ridiculous settlement: about a $25 WalMart gift card.

If I was without common sense and reason, I would have made the same, repetitive statement about self wrought pain, again, in another thread, a day after whining about someone making another joke about it.

You assume it will succeed.

I assume it will be a drain on resources. It should be thrown out the second the judge looks at the case, and in a just world, the plaintiff would be fined to the tune of whatever Wal-Mart pays their lawyers, and whatever the cost to the courts were.

Not smart, he was not the only guy in the store, he should have started a class action claiming emotional damage. Now WalMart only has to find other people in the store at that time who were not affected by the stupid prank.

The solution is simple. He gets to get on the same PA and say "All white people out of the store."

What he is talking about comes from the Stoic Philosophy. It can be summed up by the old adage "mind over matter".

If thou art pained by any external thing, it is not this thing that disturbs thee, but thy own judgment about it. And it is in thy power to wipe out this judgment now.

If he was really hurt by it, he should go after the guy that said it. Instead, he goes after WalMart. It doesn't take Sherlock Holmes to figure out what dude is really after.
