can't see how it wouldn't be. Seems like it would get struck down quick if ever enforced (but one has to wonder why it's on the books in the first place)

When has that stopped the left from doing anything? Are you aware of the Constitutional justification used in Roe v Wade to start this whole mess? How about the specious Constitutional justification for social programs?

The 10th Amendment specifically makes powers not given to the Federal gov't off limits.... the left has a 100+ year history of completely ignoring the letter of the law. I don't expect anything as inconsequential as the Constitution to slow them down here.

The law is dumb - we can't stop the Westboro morons from protesting funerals but we can stop the protesting of abortion clinics? What a world.

+1, major hypocrisy going on here. I think people should be allowed to protest whatever they want within means, especially if the Westboro d'bags are allowed to.

Yep - much as I despise Westboro I'd rather live in a country where they can do this as opposed to not. In addition, funeral attendees should be allowed to hit these people at least a couple times to even it out :)
