WTH is he thinking?

Obama is about to nominate a person that has never served as a judge, to the highest court in the land.

Yea, she was the dean of Harvard Law School, but that hardly makes her qualified for the job.

What say you?

duh, she's from Harvard. That's like liberal duct tape and makes her instantly qualified for any position

It is unusual for a justice to have no experience on the bench, but I was surprised to see just how little judicial experience many of the current justices had before being named to the court. There are numerous justices with less than 3 years or so on the bench prior to the Supreme Court.

It also is unusual for a President to have no experience.

A number of people, including GOP folks, have been for years saying that a lot of non-judiical legal experience would be a good thing.

On the other hand, I am more than a little miffed that my own phone didn't ring this morning.

I must admit, I dont know much about this lady. I would feel much better if she at least had some judicial experience, so we could see how she had ruled on some cases.

I don't know much about her either, but I know a lot about the socialist, anti-American moron that nominated her.

what worries me is we have a woman raised by two teachers who has never been a judge and as far as i can tell hasn't worked for a significant period of time in the private industry either. how screwed up do you think her views are?

I don't know anything about her.

Glad to see all of you are keeping an open mind aobut her since you also don't know a thing about her.

Oh, wait. Almost forgot. Since she is nominated by Obama, and you are sworn to do everything in your power to decry every move he makes, even if it makes perfect sense, you are obliged to criticize this selection, as well.

Sorry, almost forgot your knee-jerk anti-Obama at all costs role in the matter. Whew!

When he makes an intelligent decision, then I will give him the benefit of the doubt. His track record has obligated me to be wary of his decision making abilities.
Unless the teleprompter told him, then I might reconsider my stance. The teleprompter is much more intelligent.

You are going to try to justify it because you've had an hour to peruse Google?

Pathetic.

right and i'm sure all of your opinions about the TP come from tens of hours of painstaking research. her bio is public knowledge. i see no reason why i cannot comment on it.

You commented before you knew her bio. Not to mention whatyever litmited stuff is out there right now in the initial commentary is limited to the barest of things, like Solicitor General, Harvard, not a judge, and things like that.

I don't have a clue about her. I might well in a week come on here and tell you I don't like her. Seriously, I will if I don't think she's qualified.

In fact, I have not and will not say anything here in support of her nomination until I know more than what CNN, Fox, or ABC throw out there in the initial stories because I don't think there is much meat to any of that.

I used the word "qualified", but I don't think there's much doubt that she's capable of doing the job.

I just don't understand why Obama didn't select a sitting judge with an established record.

I don't think it's about "most qualified" anymore - it's about who the person is (personal traits) and their ideology (legal and other).

Interesting that some diversity (gender and possibly sexual orientation) are considered important but other diversity (religion and education/school (yet another Ivy leaguer)) are not considered important.

Just reading that she favors application of "battlefield law," including detaining people for long periods of time wihtout trial, if we think they are connected to Al-Qaeda.

Here's some info on her:

Obama to Nominate Kagan to Court - WSJ.com

Her decision to keep the military from recruiting at Harvard Law School that was defeated unanimously by the SCOTUS isn't a good sign about her understanding of Constitutional Law

Will be interesting to see how she explains that one during conf. hearings.

At this point my feelings are:

1) The POTUS gets to nominate; the Senate should confirm unless there are serious qualification issues - not just ideological differences.

2) It could be much worse - so far I don't see this nominee as left as I had feared.
