A majority opinion in the suit brought by PA state senator Jake Corman raises the question of whether or not the NCAA ever had the authority to punish Penn State over the Jerry Sandusky scandal.

While the Court hasn't made a ruling to strike down the NCAA's penalties, it has upheld a PA statute that prevents the $60,000,000 fine levied against PSU from being used outside of the state.

If the Court ultimately decides that the NCAA acted outside of its authority by sanctioning PSU for actions not covered by their bylaws, the NCAA is going to have yet another major problem on their hands.

I think if a school covers up criminal acts for the benefit or perceived benefit of a sports program, they should be subject to NCAA sanctions. Whether or not the NCAA's bylaws provide for that is another thing.
