Claim is: Springsteen, according to the officer, took 45 steps during the "walk and turn" test "instead of the instructed 18."

They saw him take a shot and start the engine.

I know Georgia has (or had) some sort of "zero tolerance" law. If you blew below the legal limit but failed the sobriety test or if you were at fault in a wreck you were charged with a DUI.

I live about 3 minutes from the GA state line and there was a very odd situation about 10 years ago.

This story "supposedly" happened like this: the driver was at a friend's house in GA (1 mile from his house in NC). He mentioned to his friend that he had a toothache and his friend said to swish a shot of whiskey and it will dull the pain. He does and gets in his car to leave.

While fiddling with the radio, he crosses the yellow line, hits a car head in and kills one of the two passengers. He blew below the legal limit but based on the fact that some alcohol showed up on the test he was charged with vehicular manslaughter, was sentenced to prison and served a couple of years before he was paroled.

He was about 50 yards from the NC line and if he had been across it he would not have served time.

The only way he will be convicted of a DUI is if he submitted to a blood test, and the toxicology report came back positive for some other type of intoxicating substance (usually marijuana). Any decent lawyer (and I assume Springsteen can afford one) will beat the hell out of a DUI case, if all the prosecution has to work with is a .02 BAC. That is literally just two or three beers. You aren't even feeling a buzz at .02.

My guess is that Springsteen got mouthy with the cop. He might have even played the entitled "Don't you know who I am game?". That is the only reason I can think of for why a cop would arrest someone for DUI after blowing such a low BAC.

Nah, this happened in New Jersey where the cops have a really bad reputation for tickets/arrests. I can’t stand Bruce, but it sounds like he was screwed over here.

I read where he took a single shot with some fans and the park ranger(?) that saw him waited till he got on hic motorcycle, then gave him the ticket. Sounds to me like another dickhead with a badge looking to flex.

Absolutely. I’ve driven through Jersey a few times and have never seen as many motorists pulled over on the side of the rode by police as I have in that state. They are strict.

You can be charged with a 0.0. Stands up in court and leads to a record.
You can be charged, but you would never be convicted of a DUI with a .00 BAC (as determined from either a breathalyzer or blood analysis). The arrest itself can be expunged from your record following the dismissal of the case.

Then they needed much better lawyers. I beat a DUI charge in 2007 after submitting to a blood test which came back with a .10 BAC. My attorney was Steve Oberman in Knoxville. Very well respected... but expensive.

Absolutely. I’ve driven through Jersey a few times and have never seen as many motorists pulled over on the side of the rode by police as I have in that state. They are strict.
I had a trucking client that had trucks pulled over by NJ state police and basically impounded because they owed taxes. NY and NJ are basically if the mafia could build a government.
