In some cases, they have subpoenaed cell phone records after an accident, to see if they were either on the phone or recently sent/received a text around the time of the accident.

Thats okay for crashes but for citations... I guess it will be up to the defendants to get their records if they are innocent. Total waste of time!

which is statistically stupid because you can't identify who was on the phone or texting unless there was a lone driver.

My wife regularly uses / texts from my phone when we are in the car.

That's a good point. If the driver isn't alone, surely the burden of proof remains with the State. I know lots of couples or even friends that use each others' phones while driving.

but, the stats will be passed off as gospel, even though those using them to support their worldview know better.

I agree. It would be a lot easier if the offenders would just punch themselves in the face and self correct.
