Article 1, Section 2, Clause 3: Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.

Unless I'm missing something, which is possible.

Article 1, Section 7 is the section the House Democrats are going to shred when they use the "Slaughter House Rule" to pass a bill they never voted on.

All that blather about Bush supposedly shredding the Constitution. Obama and Co. aren't merely shredding it, they're shredding it then stuffing it into a hamster cage so that it gets crapped and pissed on by their little lemming-like sycophants at MSNBC and other liberal media outlets.

You're talking about the health care bill? How is that shredding/stuffing/crapping on the Constitution?

Seriously, disparate votes for differing bills melded together by some BS amendments that are all the house is actually voting on? That doesn't even resemble our process for a bill becoming law.

Look at the WSJ editorial about it. It's hideous.

for one thing, the Federal Government has no business in health care. You can misinterpret "general welfare" all you want, Article 1, Section 8 clearly defines what the FedGov can collect taxes for and spend tax revenues on. Health care aint one of those things and is therefore a state issue.

second, you'll notice that I mentioned the "Slaughter House Rule" which is a rule change to allow the House to pass the Senate's health care bill without actually having voted on it. That's a clear violation of Article 1, Section 7.

Just to be clear: You're saying the Democrats are illegally passing the health care bill by using a self executing (slaughterhouse) rule?

That's incorrect. It's completely legal and has been used numerous times, mostly by Republicans.

Legal until challenged. It has never been used in making sweeping law.

Your ridiculous argument made slavery cool prior to the emancipation proclamation.

His ridiculous argument is that this procedure has been used hundreds of times in the past, but only now is it an issue.

Odd, huh?

No it hasn't. This has never been done. The actual senate bill is not going to be voted on because of a newly minted procedure that allows nany democrats to vote for the amendments but distance themselves from the actual bill. It's an absolute croc to try and save jobs because Congress knows full well that Amwricans are going to dithering tem for passing garbage legislation that few want.

Odd that you haven't mentioned the brand spanking new procedure.
