TransCanada seizing private land in Texas for pipeline, claims eminent domain

Wait a minute, a Canadian private company is exercising eminent domain? I believe that story is missing some important pieces of information.

My point was that a private company cannot seize land. They must have government approval to seize the land. TC is seizing nothing and is not exercising ED. They may request ED laws be used to obtain the land but that is a government process.

TransCanada is classified as a "Public Utility" and can thus utilize eminent domain same as Duke Power, TVA, American Electric Power and many others.

But the point is they can't do it without government. Government is the one actually seizing the land for one of their preferred enterprises.

How can a foreign corporation, even if classified as a utility, use ED for American property?

Funny thing, back in the '60s the media asked USAF Gen Crutis LeMay, chairman of the Joint Chiefs of Staff what he thought of the B-58 bomber and he replied it would be a great bomber if we were going to war with Canada and all the Canadians I met back in that day were fearful we were going to invade Canada.

Landowners get like $500 per piece of pipe put on their land. It comes out to around $2500 per acre, per pipeline Pretty fair for texas farmland
