Stupidity has a name. It's Derek Willis. SMH, man.

Police found him lying in the middle of the road with his car pulled over. He was apparently too drunk to drive, so he opened the door and laid down in the road.

Kids make mistakes, but he needs to be dismissed from the team.

there is that at least. still incredibly dumb to drive at all, but at least he stopped.

now laying in the road? thats pretty dumb. He could have at least been doing the Andrew Butcher work out plan. Dodging cars to improve agility.

Sounds like Billy G's chauffeur needs to get back to work.

I was thinking more along the lines of Eddie Sutton's chauffeur. Billy G's chauffeur still has his hands full somewhere in Texas.

Some of those responses in the comments section are just ignorant. One person says that a cop has to witness a driver behind the wheel to legally charge them with a DUI. That is just wrong. I know someone who was charged with a DUI after pulling their car over in a vacant parking lot and passing out drunk in their back seat. The cop had probable cause to believe he had been driving the car and he was clearly drunk = DUI charge.

Kids drink, but the driving part is beyond stupid. Needs to be dismissed imo. Can't let kids get away with this.

We all know he drove the car but like the KSR comments say there's no proof. He could've been driven out there by some buddies and dropped off as a prank. Seeing a drunk guy next to a car, it's assumed he drove there but that's all it is; an assumption.

That's called probable cause (in conjunction with a preponderance of the evidence) and it's enough to charge someone with a DUI. Whether or not he would be convicted of a DUI in court could be another story (plea agreements are usually reached in such cases, especially for a 1st time offender) but if the scenario that you described is what the drunk person claims, an officer who is doing his job wouldn't just take that at face value. Who drove you out here, son? Why did they leave the scene? Where are they now? Will they corroborate your claim of innocence? Where were you tonight before you ended up here? Is this car registered in your name?

Of course, the guy could then exercise his right to remain silent but if the cops are doing their job they should still charge him with DUI. They had probable cause to believe he had been driving while intoxicated.

The article didn't mention a DUI just a Public Intoxication.

A good lawyer could easily get him out of a DUI if it ends up there. Don't EVER talk to police. You are not obligated to talk to police.

Depends on the jurisdiction. That's definitely true in Knox County (provided it's a 1st offense)... Wouldn't be as easy to beat in some surrounding counties such as Blount. You are right about not giving information to the police. That never helps anything.
