I didn't realize that the waters off the Horn of Africa were under jurisdiction of the US legal system.

The judge can legally rule as he pleases, this particular judge has a high rate of being overturned in appeals courts though.

In this particular case the judge cited only one example in making his ruling from a case in about 1819. In that case the judge quoted a narrow definition of piracy that fit the particulars of that one case. This ruling uses that quote to make it's ruling but ignores the broader definition of piracy as it appears in legal dictionaries and other documents.

The USN was within it's rights to apprehend pirates opperating in the area.

I don't think a US federal court is the right place to try them though.

maybe the Navy should just engage hostiles the way they always have in the past and not worry about taking prisoners
