UT practice viewing policy?

I was on campus today a little past 4 and decided to drop by practice. I know it's closed but figured I'd check it out thinking at worst I could watch from the outside through the fence.

I was standing on the little hill just outside the west entrance to the outside practice field. I could see the media personnel sign in tent. They have this black wind screen to limit visibility but you can still see pretty good. So I'm sitting there and mind you... the media is still there... after about 3 minutes of watching a lady approaches from the other side of the fencing and asks me to leave stating it's a closed practice. She wasn't rude about it but she wasn't pleasant either.

Me: "So I can't watch from outside?
her: "No."
Me: "Why not?"
her: "Because it's a closed practice!"
Me: "Can I watch from over there?" I point to the sidewalk 3 feet behind me...
Her: "NO practice is closed, please leave"

My question is... can she do that? Can they really limit people from standing on the sidewalk and looking in the direction of the practice field? This seems a little extreme and a misuse of power.

Does anyone know what if she acted within the rights of the University?

I doubt they could physically remove you, but they could always do things like ban you from Neyland Stadium. If Butch wants a closed practice, don't be shocked when they tell you to get the F*** out.

Public university and a public sidewalk. I don't think she really had any authority to do something if you had said no to her.

I think you can stand on a public sidewalk and look at whatever you want to.

but are you sure that's a "public" sidewalk? If it's on UT property do they have the right to tell you to kick rocks or they'll escort you from the premises via UT police on the grounds you're loitering?

I wish I knew the law... I'd love to go back a little more prepared.

Should get a group of friends and take turns sitting on each other's shoulders. If they say anything, tell them you're practicing for the cheerleading regionals.

Butch doesn't want Vol Nation Fans or Gator/Bammer spies watching his team during closed practices, and I am like way fine with that. Let the team and coaching staff just surprise the heck out of us come game day. Sure would eliminate so many mindless threads.

Is UTK a private school now? I would think you have a right. Challenge it and see what happens.

You're just lucky Rod Wilks wasn't on patrol at that section of sidewalk or you wouldn't be here to ask.

Well, unless there is some other case law that I'm unaware of, university campuses are private property and they can dictate private vs. public access.

Unless you're an, "Am I free to go? Am I being detained?", activist and want to be arrested I'd suggest you listen to campus personnel.

Of course, I'm not a lawyer.

I noticed on the YouTube practice video's that the guy on the backhoe working on the construction project around the practice field gets a free peek on practice everyday.

I never said I was "injured" in any way. I just asked if anyone knew if she is acting within her rights. Fair question in my opinion. Sounds like you believe she was. Thanks for your input. No need for you to get your feelings hurt over the matter and post passive aggressive memes.

Yes, and if you had not left, UTPD would have asked you to leave campus.

Little-known fact, the city actually deeded over the rights to most of the streets inside campus to UT last year. UT now controls the street parking and meters because even the streets are their property. The only exception is Volunteer Blvd., which remains a city street with city sidewalks.

Even thought UT is a state institution, campus is technically private property and you can be asked to leave any part of it at any time.

The sidewalk outside of your house is public property. By law someone can technically stand there and stare into your daughters window. But if they have any respect for you or your daughter they would never do something like that. CBJ doesn't want people watching practice because he wants whats best for the team. Maybe that guy outside your house doesn't have any creepy intentions and maybe you didn't want to sell secrets to coach Satan. Either way be respectful and watch the practices CBJ wants you to watch.

I watched a few practices last year from the second floor of the old Basketball stadium across the street. Forgot what its called but I am sure everyone knows what I am talking about. The track and field team uses it for practice etc..

My son was doing speed and agility training.. although I did not know I was doing anything wrong.

That was Stokely... it's gone now. Was just demolished.

As a student you are able to go to most area of campus. If you are asked to leave said area it's probably in your best interest to do so. You can be banned from almost anywhere on campus and if it came down to it arrested for trespassing, even as a student. Just because the state owns the property doesn't give anyone the right to go where they want.
