That could be the stupidest thing I've ever heard! Wonder if the defendant will plead the 5th?

Yes, that is silly. Dog's are property under the law, not people. It should have been the owner of the dog that was served.

On the other hand, if my dog causes some damage, it would be nice if it was his responsibility and not mine. His posessions consist of a blanket, a collar and a rawhide bone, where mine are slightly greater in value. I think I would rather have someone suing him than me. If he can't pay, maybe he can do community service, which in my area generally consists of washing golf carts at the municipal course. Not sure how he'd hold the hose, though...

Wow, yall hear about 4 or 5 years ago someone broke into a house and was attacked by a dog and sued and won? Did i make that up?

Generally only a "person" has the right to sue or be sued. Under our laws corporations and human beings are "persons." The judge should probably just dismiss the complaint as to the dog and make the plaintiff substitute the dog's owner as the proper defendant. If someone sued a dog and won it probably happened in another country. I know that some European countries have bills of rights for animals but I am not sure that they have civil rights such as the right to sue or be sued.

If he is convicted where would he either serve time in the Pound forced to join the gang of Poodles to stay alive. Or will he have to pay a million biscuits in damages. Will have to keep up on this story. Can't wait to see how it ends.

I totally agree that this is stupid but, if you kick a police dog isnt the charge assaulting a police officer? Not destrction of property.

According to O.C.G.A 16-11-107. Destroying or injuring police dog or police horse.

Any person who knowingly and intentionally destroys or causes serious or debilitating physical injury to a police dog or horse, knowing said dog or horse to be a police dog or police horse, shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not less than one nor more than five years, or a fine not to exceed $10,000, or both.

Those animals include Accelerant Detection Dogs, Bomb Detection Dogs, Firearms Detection Dogs, Narcotic Detection Dog, Patrol Dog, Police Horse, Search and Rescue Dog, and Tracking Dog.
