The number of justices is controlled by statute, not the Constitution. Change the statute and you can decide how many justices are on the court. It's just a regular piece of legislation. FDR famously threatened to pack the court during the new Deal

Republicans would have no reason to change it since they should have a solid majority after this appointment and it'd be a political liability for them. It would be a huge political liability for Dems too, but one they may be willing to risk if they feel the Court becomes too far out of step with the mainstream.

Calling it a "resignation" gets a few more clicks and faux outrage drawn from the left. It makes it sound like he's doing so in protest or being forced out even though he's retiring at an age where many folks retire and enjoy the remainder of their life.

The left will not be able to discredit anyone who is nominated both liberal and conservative are qualified to be on the bench this is why election matter you made out like the persons ideology but you cannot say they’re not qualified.
