Why would his lawyers have cloned his phone 12 days ago? And then they just happened to turn it over?
Maybe they just meant to turn over part of it? Idk why they would do that, either. Not like he turned over anything else.
I mean, whatever, I’m pretty sure it’s fair game if he lied about not remembering any emails yesterdays but was sending emails 12 days ago.
It does seem unlikely that that could happen by mistake.
What did his lawyers want his phone for, in the middle of trial after already blowing off discovery, though? Apparently they didn’t assert any privilege over it when notified of their mistake. That seems weird, but I don’t do enough civil litigation to really know.Often times I will preserve the evidence if that has been requested or I will gather evidence in discovery, even if I plan on objecting to its production, because it is easier to have at my finger tips. But it is always saved in a folder marked ACP, so that it does not get produced accidentally.
