FRESNO, California (KFSN) -- An Oklahoma man is behind bars accused of murder after deputies in Pottawatomie County say Brad Lee Davis killed his stepfather by giving him what is known as an atomic wedgie.

hate to be that guy. someone lost their life. regardless of how it happened, its sad.

everyone is innocent until proven guilty. the bop lay with prosecution to re-create pre-meditation for a murder charge. most likely this is a manslaughter charge. sad.

lawyers on here would know more. especially as it pertains to ok law. based on statutes in tennessee, he acted with pre meditation to cause injury, maliciously. i hope a jury would see that. what a weird case. fighting is never a good way to resolve issues, obviously.

Wedgie sounds like assault. If I punch someone in the nose and send a bone shard into their brain that causes an aneurysm and kills them then I take the murder rap even if I never intended to kill them. The question is whether the wedgie was intended and not whether death was intended. If you can figure out how someone accidentally gives an atomic wedgie the you have the makings of a defense. Otherwise you just hope the jury ignores the law and gives you a sympathy vote, in which case justice is not really served.

I think you're mixing up intent and premeditation...
