Since this is a TEAM sport and UT's shortcomings over the last several seasons can be attributed to team chemistry, the real issue is the impact on the team.  What message does it send?  Will the borderline players (we've got em) see this as evidence of a "free pass" or will it make them realize what they are risking with their actions.

Going back to what I posted earlier, I think CPF could send a clear message to his team by allowing Banks to return under the condition he will adhere to whatever hoops CPF wants to put him through.

Think about it. Banks going through 1,000 hours of community service, 16 laps a day at the UT tracks, nothing less than a C on his report card (as well as a few other things) could show the entire team what will happen if you screw up. Yes, the opportunity will be there. But you are gonna be humbled into becoming a team player if you cross that line.

but what about the message that "hey, you be a team player and don't cross the line, cause you won't be back." That is the lesson the team learns if Banks isn't allowed back. Which is better? He had his chances before he got kicked off the team, be a man and accept the consequences.
