My experience has been that if the at fault party does not have sufficient coverage, my insurance paid the difference then sued the other party for more than enough to cover it plus legal. They would get a judgement which is good basically forever.

If you are a SF client and you file an uninsured motorist claim through them, they are the lowest of the low.

Spouse got in T-boned in a wreck, had head/chest scans done. State Farm has taken the position that it wasnt the uninsured drunk motorist that caused her stitches, it was the sunglass clip on her visor.

Their thoughts on the stitches doesn't even make the Top 3 ideas about how they aren't trying to pay her claim.

As a client I never had an issue with them taking care of a claim quickly. I've heard horror stories about how they treat people going after a claim on one of the clients.

I'm in Knoxville.

A couple people have mentioned / asked and yes, my insurance is coverage the repair costs with no increase in my insurance, but they will not cover the rental car after 30 days. My rental ends on Friday and Toyota has yet to even disassemble my car so who knows how much longer it's going to take.

I'm still confused on why the other guys insurance isn't helping at all.. even if the damages are past his coverage you would think they would step in when they could.

Ask for Andrew and see if he can help you out on the rental price. Good, local company.

Most insurance policies will have a max for 30 days rental, but the majority of reputable companies are extending those days to at least 45 because parts are impossible to get right now. You may have to ask your adjuster about this. I know there are many adjusters that aren't aware of this yet.

This may not be an ideal solution for you, but it may be cheaper just to buy an inexpensive car through Craigslist that you can drive for 2 or 3 months and then turn around and flip it for what you bought it for or even more if you want to put a few dollars in it to make it more presentable.

Have nothing to add OP but so sorry you're going through this. A buddy of mine's granddaughter is on her insurance and was in a wreck a month ago and she is having the same trouble. The 30 days for the rental has run out and the auto body shop is still waiting on the parts to come in as they told her "they're somewhere at a port and can't won't be in due to the pandemic".. She has State Farm and has had them for over 30 years she said they have been no help at all and neither has the rental company "Enterprise".. It's sad. I always say that the biggest scams are car, life, and medical insurance.... you pay so much money into policies and when you need to file a claim it's like the companies want to slow poke or stiff you.. SMDH...

Anywho, good luck OP and I hope your problem gets rectified soon.

Ouch. I have been a SF customer since I was 16 years old and never filed a claim in 16 years. If something ever happens and they try to pull some slick ****, I will burn the building to the ground. Hope they are insured for that.

That's a terrible situation that you are in, but not an uncommon scenario. Too many people carry minimal policy limits, which is oftentimes not enough to cover an incident. He probably has a minimal policy limits on the property damage that his insurance company will pay out. They will not pay a penny over his limits that he has with them. You can go after him personally, but you need to make sure that you can collect. I'd ask for them to provide you with his Declarations Page to prove what his property damage limits are.


Yes and you can talk to an attorney who would probably do a basic assets check to see if he is likely collectable for whatever you might be able to recover. (Not sure about there but collection down here is very difficult and narrowly allowed). If he has no assets, going to be tough to make it worthwhile.

They owe you guys a duty to treat you fairly, since you are their insured. They are potentially committing bad faith.
I had to go to court and testify over the handling…. Or lack of handling of a claim. The insurance company could have handled the claim correctly at the time of loss for $150-$170k, but chose to be incredibly incompetent and ended up losing in court, getting a bad faith ruling and paying out $992k

It's actually a Lexus GX460.. I hope it's not totaled because I got it used in August and have already put about $15k in suspension, wheels / tires, roof rack, tent, etc... into it. It's been built to live out of when we go on our off roading trips.



They, Progressive, aren't paying anything. Not even up to his limit. That's what is confusing to me. My insurance is only going after what they are paying and not what I would have to pay for a rental out of pocket. I'm about to ask for that now!

Redneck pimped GX460. Someone knows their off-road vehicles. Tha'ts a shame on that getting pelted.

I was in a wreck as a SF client that inflicted some pretty good damage to the 3 cars in front of me. they were great to handle all the claims and two weeks before statutes expired, got sued by the driver directly in front. Her son was a lawyer. They went so far as to have me go back down that stretch of interstate and video from the front dash. They ate her sons lunch, and didn't pay a dime on the law suit. Never made it out of mediation.
