He was passed out at the wheel for numerous cycles of a stop light. If he wouldve took his foot off the brake when his light was red he very easily couldve killed someone! The magnitude or lack of and timing should not have any affect on the suspension!

Exactly. It should be commensurate with a DUI. The potential for having killed someone doesn't matter. Bad engineers in SKorea do something worse every day, but none lives up to some kind of new fangled "coulda killed someone" legal standard.

Wrong. Someone shoots a gun. “The magnitude or lack of and timing” directly affects the severity of the punishment (e.g. public endangerment, assault, attempted murder, homicide, murder). The punishment is determined by the outcome and not potential outcome.
