The penalty could not be declined because the whistle was blown before the snap. Just like a false start or delay of game, you can't decline it because there was no play.

I've always thought that 12 men on the field should be a live ball foul. If the other team plays with 12 men, but you still get a big play out of it, why shouldn't you be allowed to take the result of the play?

I didn't see it when it happened, but it sounds like it was a dead-ball penalty before the snap. If so, the whistle should (and may) have blown before the snap. It's not like they committed a penalty during the play. And, as another poster said, no one is going to "ice" a FG kicker by committing a pre-snap penalty to make the FG closer. Illegal substitution is pre snap. It's just unfortunate for Duke that the snap and kick still happened.

You have it right. The whistle blew before the snap, Duker either didn't hear it or decided to snap it anyway.
