Dealership wrecked MY brand new car

Yes...and they asked for it back. They said my primary insurance would cover it. My insurance company said, don't return it. Not that I would, they would have to come picked it up as I would have left it abandoned.

I've talked to him more than 15 times on the matter. The problem I have is that the dealership is doing everything to force my hand to get my insurance involved and it's something I just don't like.
 
I have a feeling that there's more to the story. Something just doesn't sound right here.
The story goes, wife took my new car for it's first oil change at a dealership (not the one I bought my car from, it's more than 2 hours away) and they wrecked it on the lot. Now they want to wash their hands of it. We are 100% not at fault in this, except taking it to a dealership that is the worst of it's kind.

Tl;dr Do you ask for medical advice from the guy pretending to be a doctor on the internet or do you go to an office? Same for legal advice.
 
Now you don't have a clue about what you are talking about. That is 100% wrong information.

Only an extremely small non admitted company would not have its own legal counsel.

A dealership would not use a non admitted in this case as the manufacturer would rewuire to be an AI and rewuire a A rating or better.

Even companies like direct have their legal team.
 
I have stated for years I am in the insurance industry.

Gavol has my email address as does freak.

I work in more thsn one way with insurance companies and represent over 40.

Ask freak or gavol to verify.

And no I am not just an agent.


They can easily email me and then google the websites.

If this is directed at me, my response is that there are lots of avenues to go in this direction and i was seeking advice from people given the same situation, what would you do. It's a good way to foster ideas that i may not have thought of with people that may or may not have more expertise in the area.
 
The funniest part to me is that the dealer has offered the worst of the worst outcomes and made that their offer. They have not even begun to see MY worst. Media blitz process began today. It's only going to get uglier for them.

I need to be more clear about what I mean when I state outside lawyers.

Insurance companies have lawyers on staff one of two ways.

1) through corporate on salary.

2) Hired law firms.

The hired law firms almost always work solely with the Insurance company and are not consider outside legal.

The insurance companies that normally use a firm are much smaller.

All insurance companies have a firm on retainer but they are already locked in a billing rate.

The theme here (and I apologize if I miss understood) was that an insurance company would go out an hire a lawyer....that is never the case.

The either are using a firm or their own staff.

The Big 10 mainly use their own staff though.

Could we wrap up the personal attacks? I only started this thread as a discussion for a problem that I thought was worthwhile for the pub. I've gotten solid advice and not so solid advice, but that's what I'm seeking. Later I will start my own personal attack on the dealership.

How have you started the process?

Did you file a claim through your company and sub or did you hire a lawyer yourself?

Or are you still in the decision process?
 
I would also go for pain and suffering at this point.

I know you were not physically injured but I would go for mental anguish and emotional trauma.
 
Any agent worth a damn will hold your hand through the process and go to bat for you. If they don't, change agents.

Are you 6 and 7 licensed also?

Kinda curious.

I never got my 7.

Just the 6.

I've cleaned it up to try and get the focus back on your problem.

It is absolutely perplexing that the dealership is trying to deflect this to your insurance company. They're playing this 180° From how they should be.
 
I am shocked by that also.

I am also curious how the manufacturer is going to handle this once they find out they are in a suit as the additional insured.

They may put pressure on the dealership to get this corrected.

Gotcha. My comment was more general to the board as a whole.

I love my cars. If I buy a car it is because it is exactly what I want. My mom tried to trade in her car, they pulled a carfax, and saw that it was in a wreck she had forgotten about. It was a fender bender. Offered her 3k less. I sold a car to carmax. They pulled a carfax and saw it was in an accident before I bought it, which I knew about. Offered me less. Point being, if it was my new car and it will be tainted for resale due to no fault of my own, the person or business responsible will make it right in my eyes. If I'm not satisfied I would sue because sometimes that's the only way for people or companies to do the right thing. I wouldn't do the media thing, but to each his own.
 
I know very little about that segment.

I guess you work for a bank then or maybe a wholesaler.

I'm an independent agent. Effectively I'm the middle man between a bank, finance company, credit union etc and credit insurance, force placed and fee income markets.
