Most of the 'stupid' and 'he's failing' rumors are just that rumors. I'm sorry but you can't tell whether your classmate is passing a class or not by attendance. I only showed up for tests in one of my larger classes and still aced my class. Not saying CP is acing things but there is such a thing as studying friend's notes, the book, taking tests, and turning in halfway decent papers. He may also be with disability services due to a learning disability which would mean only he and his professor would know -- at UT, disability services proctors those exams as they are not taken in class with everyone else.
As a prof, I've sent over plenty of exams for them to proctor and they send it back after the test is completed.
I've taught more than one student who just didn't care but I've yet to teach one that was truly stupid and yes that includes football players. Immature or ignorant yes but not stupid.
As to JUCOs... they can actually be more difficult for a lot of students than a regular University because of the way they're set up to emphasize core requirements. In a lot of ways, they're structured closer to high schools with less freedom and more boredom which also kills a lot of students who aren't cut out for that type of learning.
I think a lot of these speculation is based upon the fact that he had to go to a JUCO because of his high school grades along with a general fear around losing all the talent within the program. But bad high school grades aren't indicative of much at all.
