Ok I can see where this jackarse judge is coming from. It is unfair to expell a student athelete for something and not expell a regular student for the same thing. I agree totally. With that said, I don't agree that he should be reinstated to the team with all benifits(houseing, tuition). Yes he should be able to remain at school and take classes, but why doesn't the school have the right to revoke his scholarship and kick his thug arse off the team. Make his sorry butt pay his way through school like most of us had to do. Let him come back and pay his own way. My bet would be he would drop out before he would be able to pay! It is a privealge to be on a College sports team not a right!!! This can have detrimental effects on all college sports. All the thugs are gonna get turned loose in college. One last note: They said he had to reistate to the team. Hey, thats fine They don't have to let him PLAY! One reason I don't believe GT is handling it properly Chan Gailey stated the thug would be able to play and Gailey said he would play him this weekend! That looks bad for Chan Gailey and the program to let him play. Then again everyone has the right to innocense until proven guilty.

As a professor, I've served on Judicial Review Boards at universities. These JRBs hear cases against students (conduct, academic misconduct, etc.).

The decisions made by the JRBs include things such as suspension, expulsion, etc.

We never had any input into team participation - just university.

That said, there was a hearing and rulings were made.

The standard of guilt was preponderance of the evidence not beyond a reasonable doubt.

I assume Ga Tech went through this process. It's possible that the punishment (expulsion) was not in line with what other students who had committed the same acts received. I can see the courts requiring the university to use the same standards for access to the university.

However, I still don't see how the court system reaches inside the university to the football team level to say who is on or off the team.

1. A court interpreting or ruling on the facts under the law has nothing whatever to do with fairness; it's a legal matter. So whether or not you, me, the college, or the courts think it's fair or unfair is quite irrelevant. A college has the right to expel students for reasons they see fit as long as they are not breaking the law in doing so.

2. Everyone has the right to innocence until proven guilty so far as that innocence relates to the law of the land. That assumption is not necessarily provided to someone under a private situation or one where an enity has rules by which its members (students) abide under a code of conduct. Under these situations a person is not afforded protection under law because it is not a legal matter but a private one. Therefore, because this is a voluntary association between a student and a college, that college is well within in bounds to evaluate the student according to their own codes of conduct, i.e. grades are too low, and they have a policy regarding that situation.

Strange, Montrell Jones sucked when he was here. They said he was a little slow and had trouble getting open (sound familiar). Now, he seems to be doing fine. Interesting.

I'm not sure James Banks could get into the complex without setting off the security alarms. His synthetic member would have to be left behind - and I do not know if he can part.

Isn't that what usually happens to UT players? They go somewhere else and actually play better, like in the pros. What does that tell you about player development?
