Just so you know, this guy that we "flexed on" was well known, and well liked, and had been recruited by half the kids we had on the squad at the time. If he winds up in the NFL he could have already. We really did damage his reputation and he took no action. He doesn't HAVE to be in college at this point.

Sure he could. Anyone can sue anyone. Would he have prevailed? Did he REALLY want the sworn statement regarding his knowledge to be explored?

I missed that trial. Tell us about it. I know he was accused of knowing by McQueary. Doesn’t mean it’s true but did Schiano ever sue McQueary?

Try again. Sworn deposition testimony is evidence. Is it true? Is it enough? Is it credible? Those are fair questions. But it IS evidence, and sworn at that.

"Anybody can serve sue papers on anybody for anything they want", the old country lawyer told us on the jury he was speaking to that day. He paused and added "however proving your case in court to prevail is the secret." That old country lawyer was correct and our jury saw it his way thst day, I've never forgotten it. Schiano would never have prevailed in a Knox County Court and he saved himself $s in attorneys fees in a losing effort.

Honest question, my Vol brother: why do you feel the need to defend him so vigorously? Heck, I have no idea what was true and what wasn't with respect to Schiano, but I have never lost a moment of sleep over any perceived injustice to him. I don't get your dedication to his cause.

It's not allowed in civil court, either. It has to fall under one of the exceptions, and there's no way that "Gud Bradley told me that Schiano told Bradley that Schiano saw Sandusky..." falls under any of the exceptions.

Didn’t follow the OJ civil trial? Allowed a lot of hearsay. You simplified McQueary’s account, I’m sure it would’ve been allowed. This is all beside the point. IF Schiano sued the university because of damage to his reputation? He would have to introduce all this other crap, himself. Fans didn’t invent the allegations…they REACTED.

And yes, I simplified McQueary's account, but it would in no way be admissable even in a trial where Schiano was a party. McQueary never claimed to have heard it directly from Schiano, and Gus Bradley has steadfastly denied ever telling McQueary any such thing.

That said, the entire idea of Schiano suing is absurd. Who would he have sued? Random fans on the internet? No one at UT ever said anything remotely defamatory.
