I don't understand. He was looking out the window and saw this and shot at them as they ran off, but they also almost ran him over?

My suspicion is that he originally claimed he ran outside and fired at them as they drove away. The law pretty much anywhere is that you can't shoot at thieves who are running away from you. Now he's saying they almost ran him over. If that were the case, they'd never have charged him in the first place.

I'm going to give him the benefit of the doubt and interpret that as meaning he saw them steal his trailer from out the window, then ran outside with his gun to confront them and almost got run over. Though the way the article is written the sequence of events is anyone's guess.

If things played out the way this man has claimed I would hope that a jury would not convict him.

Regardless of his guilt - what about the obvious guilt and illegal nature of the guys stealing the trailer. At a minimum shouldn't they all be charged?

Of course they should be charged. I was just talking about the guy that shot them. As I say, my guess is that he told the responding officers that he fired at them either from inside the house or just outside as they pulled away. Would be curious to see the incident report from the first-on-scene officers.

1. The wounded thief was shot in the face.

2. The other thief has admitted stealing the trailer but hasn't been charged and instead is under investigation.

3. The charges filed against the 82 man are an obvioius overreaction.

4. I'd say the DA has his head up his ass.

5. Where is the justice??

My guess is the old man was in front of the vehicle if he shot the guy in the face? Is it considered fleeing when they are leaving with stolen property?

Since the guy was shot in the face it would make sense if he was in front of the vehicle. It was his property, he was trying to protect it by standing in front of the vehicle. If the thief's tried to gun it to get away while he was in front I think he would have every right to fire his weapon in self defense, at least that's how I see it in my eyes. We must have laws that protect the law abiding citizens, not crooks.

These guys will be back in Mexico by the time the DA tries to have them arrested.

Trying to run over someone should be an automatic charge of attempted vehicular homicide plus he admitted to grand larceny, that's two felonies minimum, not counting their illegal status.

OTOH the 82-year-old Robert Wallace who said he fired two shots at the two men when they tried to run him over while stealing his flatbed trailer, now faces twelve felony counts, including four counts of attempted first degree murder, for what he described as an act of defending his property and his life. If convicted, he could spend the rest of his life in prison.

One of the thieves, Damacio Torres later admitted to the theft. He and his partner in crime, Alvara Cardano both have prior arrest records and are believed to be in the country illegally.

Damacio Torres, is suspected of being a part of a major car theft ring.

But they are not facing any charges.

Evidently Alvara Cardano is planning to sue Wallace for shooting him.

Wallace does have his trailer back but no word on whether anything that may have been on the trailer has been recovered or not.

I agree, if he chased them down for vigilante justice then he broke the law. If he tried to prevent a crime and during the process those committing the crime gave him any reason to fear bodily harm then he was within his rights.

I will have to hear more about what happened. He could have shot the one dirtbag as they were fleeing, and he turned around and was looking behind at the guy with the gun. They should also be charges with a crime.

The U.S. government needs to quit bending over for Mexico. The republicans want the cheap labor and the dems want the votes so we're in a no win situation.

What's missing is discussion of what the man said when police first got there, or maybe even on 911 tape. My suspicion remains that, without thinking about it, he admitted that he shot them as they were on their way out, and not coming at him. Otherwise there'd be no sense in the prosecution.
