Illegals go free - 82 year old man may spend life in prison

What's missing is discussion of what the man said when police first got there, or maybe even on 911 tape. My suspicion remains that, without thinking about it, he admitted that he shot them as they were on their way out, and not coming at him. Otherwise there'd be no sense in the prosecution.

What's also missing is the three illegals getting charged for the crimes they committed.

Can you explain that further? Once again, he was shot in the face. If you were to shoot someone in the face, it would make sense that they might have been coming in your general direction, and he was taking self defense.

An update. Looks like he shot at them driving away. ICE has arrested one guy and the locals the other. They were being investigated by a car theft task force and that group didn't press charges and cleared the locals to go ahead.

What's nuts is the guy fired two shots and there were two guys but somehow he's facing 4 counts of 1st degree attempted murder? Was he doing the "Wanted" curve the bullet trick so each shot could have killed both guys?

The U.S. government needs to quit bending over for Mexico. The republicans want the cheap labor and the dems want the votes so we're in a no win situation.

What you say is cliche these days but not altogether true about the republicans.

The other 2 counts are for their cousins they were to pick up at the border, after the raid.

So from what I gather, he shot at them fleeing the scene, and it hit the back of the truck. So from that, one of the suspects suffered a wound to the face. I'm assuming it was the side of his face, by what he said, in that he never shot at them from in front of the truck.

I'm not a lawyer, but from what I gather in the State of Colorado, he's sadly in trouble. Obviously because they were fleeing the scene. The "Make My Day" law doesn't protect him in this case. Unless I've missed something.

18-1-706 - Use of physical force in defense of property. A person is justified in using reasonable and appropriate physical force upon another person when and to the extent that he reasonably believes it necessary to prevent what he reasonably believes to be an attempt by the other person to commit theft, criminal mischief, or criminal tampering involving property, but he may use deadly physical force under these circumstances only in defense of himself or another as described in section 18-

18-1-705 - Use of physical force in defense of premises. A person in possession or control of any building, realty, or other premises, or a person who is licensed or privileged to be thereon, is justified in using reasonable and appropriate physical force upon another person when and to the extent that it is reasonably necessary to prevent or terminate what he reasonably believes to be the commission or attempted commission of an unlawful trespass by the other person in or upon the building, realty, or premises. However, he may use deadly force only in defense of himself or another as described in section 18-1-704, or when he reasonably believes it necessary to prevent what he reasonably believes to be an attempt by the trespasser to commit first degree arson.

The extra counts could be state and county charges, a lot of the time when they charge somebody they will add as many counts as they can, plea them down or drop the ones they cannot get a conviction on.

His problem is that he shot them as they drove away, did not report shooting at them, and lied to the police when they first questioned him.
