If you want to loan more than $10,000, then there are some specific rules you have to follow. You’ll want to charge interest and it should be at least the same amount (or greater) than the current applicable federal rate (AFR) of the month during which you begin the loan agreement. The House Oversight Committee published evidence on Friday that the President's brother James Biden received a $200,000 loan from a healthcare company he was working with in March 2018 – and the same day wrote a check for the same amount to Joe, marking it as a 'loan repayment'.

It is the first evidence of large direct payments to the President from Biden family members involved in shady overseas deals, and was obtained via a Congressional subpoena of James and First Son Hunter Biden's bank records.

In an exclusive interview with DailyMail.com, Bush administration White House ethics chief Painter said that the President could face serious consequences if he can't produce evidence the supposed loan is real, and demanded his aides show the receipts.


'What is absolutely critical here is to find documentation of the original loan from the President to his brother, and the President should produce that,' Painter said.

'If there was no loan, there are serious questions about whether this was income for tax purposes in 2018. That's really a huge problem.

Painter also questioned why payments on the alleged loan were not reported on Joe's government ethics forms.

When he announced his bid for President in 2019, he was required to file a statement with the Office of Government Ethics (OGE) listing his income, assets and liabilities dating back to 2017.

OGE rules say Joe did not have to report the loan itself on his disclosure forms. But Painter said interest earned on the loan could be reportable as an income source for the then-presidential candidate.

Even if this was a personal loan repayment, it’s still troubling that Joe Biden’s ability to be paid back by his brother depended on the success of his family’s shady financial dealings.

Just for context here. Rudy Giuliani was mayor of New York. He left office and went back into private practice. He immediately becomes a named equity partner at Bracewell Giuliani, but does no real legal work. He was there solely because of his status and contacts. He had lots of contacts from his time as mayor and as head of the SDNY. This is what famous political figures do after they leave office and government employment. If you wanna create a law preventing this, fine, do it, but until then, you're just screaming into the void.

It's Joe Biden's favorite place – his summer home in Delaware where he has decamped dozens of times during his 1,000 days as Commander-in-Chief.

He bought the home at a time that it appeared his political career was over – five months after his Vice-Presidency had ended he was well into his 70s and after all he had decided to forgo a 2016 run for the top job.

DailyMail.com has discovered that then-private-citizen Biden, who had spent virtually all his adult life in public service, bought the home for slightly under $2.75 Million – in cash.


And making the transaction even stranger it was within weeks of a highly questionable text that Hunter had sent to Henry Zhao, an associate at Chinese oil giant CEFC asking to seal a deal worth $10 million a year.

First, Joe Biden wasn't a public official of any kind in 2018. Second, family members seldom prepare receipts for loans to other direct family members, even for large sums. Biden is not obligated to produce a receipt, even if he got one. And if there was a receipt, it was probably trashed 5 or more years ago as there would be no reason to keep it after repayment. It's a /family/ loan. Biden is not obligated to account for every check he wrote or received as a private citizen just because a bunch of GOP yahoos want to smear him.

"The Oversight Committee's description of the $200,000 check is highly selective and misleading," Fishman said. "The Committee has the bank documents that show both the loan Jim received from his brother in January 2018 and the repayment by check six weeks later. At no time did Jim involve his brother in any of his business relationships."
