secretary Jen Psaki said an appeal is needed not just to preserve the 15-day extension of the mandate but to preserve "CDC authority over the long-term" in case the pandemic worsens again. "Because as we've noted from here, we expect there to be ups and downs of the pandemic. And we certainly want the CDC to continue to have this authority."
If the appeal succeeds and passengers are forced to wear masks on planes again, the president could face political blowback.
Thats the problem. Dems have stacked so many courts with their leftist loons theyll know exactly where they want to go get the outcome they want. This guy's spot on. If they had any evidence, they'd have it or an allusion to it in this release. Instead, they're just acting as usual and claiming they know better despite numerous failures. Barring an absolute disaster of an activist judge they'll get butchered in court.
Desires of absolute power from unelected bureaucrats. Not only do they not want responsibility for their actions, but they also want to play outside the law.Was listening to NPR this morning, because all my radio stations do talk now in the morning, and they were discussing the court case against the masks.
The host asked their expert why they hadnt appealed. The guest responded, because they are afraid they will lose at both the appellate and supreme court levels. and if they do it would set new precedence for those courts to rule on pandemic related issues. And they didnt want the Supreme Court to be able to rule/reference the appropriateness of certain pandemic specific measures.
It was all very leading and implied a good bit of the CDCs mindset. They want to be able to have sole authority over the goings on in the nation during a pandemic they get to declare.

Per the story they are in district 11 which leans right. I am sure there are some lefties there and they will look around. Now they are appealing to preserve the authority of the CDC per Raggedy Ann. The way I see it playing out is the DOJ will judge shop to get the ruling overturned which will take a few weeks then the CDC will drop the mandate making an appeal to SCOTUS unnecessary. That keeps the new found CDC authority intact and would be a win for the administration.
