Guy starts a personal injury thread and the first two to respond are lawyers offering their services. Surprised I haven't been bombarded by Bart Durham commercials

My wife had a bad slip and fall at Wal-Mart. No signs were up or anything and we think she may have tore some ligaments in her knee. We have a MRI scheduled. Just wanted to know so dos and donts before we speak with their insurance company.

Walmart fights these kind of claims daily. They have a team of lawyers just for these types of situations. I know a guy who works at walmart in automotive. He got hurt in the pit working on a car. He didn't report it immediately because he thought he was fine. The pain didn't hit him until the next day. He went to the doctor to get an xray of his ribs and they said he had hairline fractures or something. He goes back to work to try and get the bill covered. I'm sure not only did they mention that he should have reported it immediately but they also came back and threw a technicality at him about not having a helmet on while in the pit so any injuries he may have received they aren't obligated to cover. There is no apparent rule that he's aware of that states you must wear a helmet in the pit. They were already trying to not give their employee any coverage for the issue and were fighting him.

I'm pretty sure do to workers compensation laws that they can't deny him coverage for not wearing any kind of PPE. If he got hurt at work, he's covered under workers comp, whether he reported it immediately or not.

There's a time limit, but ours is a stickler like that, if we don't report it immediately, we are essentially screwed. Say you twinge your back,(pretty common) think it will heal/ease up in a day or two, but continues to get worse, they'll come back and say you did it while you were off, we aren't covering you.
