Maybe I am misunderstanding your point here, but the NCAA dictating/interfering with how Spyre chooses and engages with it's clients and customers is clearly in violation of antitrust laws. The NCAA is not a government agency and does not have authority to regulate commerce in any way. They cannot enter into a contract with schools that would prevent private businesses from operating as they see fit. That is the sheer definition of market manipulation, because then they can indirectly control market valuation. There is no scenario where that holds up to judicial scrutiny. You cannot tell Spyre where and how they can do business, as long as what they are doing is legal.

The NCAA cannot make Spyre engage with clients at other schools if Spyre sees no business value in doing so.

The NFL and the NFLPA collectively bargain rules around endorsements, but importantly, they cannot limit how much a player can make, and cannot lock an agency out of doing business with a player, no matter what team the player is contracted with.

I don't know if Spyre only works with UT, but I do know that the NCAA cannot tell them who they have to work with.

The bottom line is this:

- NCAA and schools can limit/cap direct payments
- NCAA and schools cannot interfere in any way with a player or a player's representative from entering into an agreement with a third party
- NCAA and schools cannot regulate collectives any more than they can regulate fast food restaurants or radio manufacturers.
- Spyre can say pretty much whatever they want in their promotional materials. Redbull does not, in fact, give you wings, and Spyre may do all the things they say above.....as long as it benefits UT. The NCAA has no say in how Spyre operates its business.

If I remember correctly, when the NCAA filed their original claim investigating UT's NIL deal with Nico, Spyre came out and said their NIL deal was with Nico and had no requirement for him to go to Vols. They would have honored it wherever he went, so the NCAA claim was invalid as far as UT.

Now, maybe that was a designed comment to protect them and UT or what but they made it clear it was not a UT specific deal.

They don't work with UT. Legally speaking, they work with individual athletes.

There’s probably a lot of verbal agreements that never work their way into a physical NIL contract. Not just Spyre/Tennessee but all football programs and the collectives associated with them. I doubt the Ohio State collectives are making deals for athletes at Michigan or any other school. Likewise Alabama’s collective isn’t representing any Tennessee athletes or anyone else not playing at bama.

What would be the fastest way to kill the donations from UT fans/alumni to spyre? Have them represent players at other SEC schools.
