I've not seen that stated anywhere in any documents. If that is/was the case we'd likely be in the exact same boat and UT would have to prove their case as opposed to Jennings having to prove hers.

The word "insubordination" was not used until very late in the ball game here. This ball has been rolling down the hill since 2010.

This set of circumstances is usually referred to as constructive discharge IIRC. I also believe courts make no distinction between being given an ultimatum and being fired... at least for purposes of determining issues such as these.
