I think more of the A listers will have this added to their contracts going forward...and I don't think same day streaming will go away post pandemic which sadly means the end of theatres...they were struggling anyway and you can't survive when half your revenue is gone via ppl streaming at home...guess we made the right decision to build our outdoor media center...wish I had a room big enough for theater seating.. large screen and for good measure a popcorn machine inside

You shouldn't be because it's been laid out pretty clearly why; what I'm shocked at is you're using a crapton of 20/20 hindsight to absolve Disney. There was absolutely no reason to even remotely think same day release to streaming was a possibility when this contract was made because there was no way in hell pre-pandemic it was a possibility. Saying they needed spell out "anything that could potentially impact tickets sold" is not even remotely reasonable.

You seem to be digging in instead of using some common sense here and there's a reason you're on an island.

Streaming has been available long before this movie was made. Obviously it became more popular during the pandemic but that’s no excuse in my perspective. These entertainers paid big money to folks to protect their interests and those folks failed Johansson and they should be the ones held accountable. If Disney didn’t violate the contract then any law suit against them should be dismissed as frivolous. Lawyers typically suck and hers appear to be attempting to deflect blame elsewhere for their poor performance
Yes streaming existed. But big budget movies weren’t released IMMEDIATELY on streaming platforms before the pandemic. That changed and so will FUTURE negotiations. In the meantime, already completed and produced films are subject to the flux. This is a non-winner for all sides.

If these actresses want to sue anyone, it ought to be their agents for not including a stipulation in their contracts for how long after it was released in theaters before it could be streamed. I’m assuming they sign contracts to perform in movies and pay professional agent companies with hoards of lawyers who they pay 10-15% for representation. They’re the ones who dropped the ball
Now wait... no one is clairvoyant enough to have seen COVID coming. I think you are being ridiculous in expecting that kind of language in the contract.

Either Scarlett is going to win this lawsuit or Disney will settle with her for an undisclosed amount. COVID or no COVID, what Disney did was in fact a breach of contract. Unless there was a clause in the contract stating that unforeseen events such as a global pandemic can and will affect the manner in which the film gets distributed and in turn affect salary arrangements, I don't think Disney has a leg to stand on. What Disney should have done is get out in front of this month's ago, approach Scarlett and say "look, we know what was contractually agreed upon but no one could've foreseen this. Let's discuss a settlement and see if we can meet somewhere in the middle." But they didn't. Their hubris reared it's ugly head and they thought they could just get away with simultaneous theatrical/streaming their films with no consequence.

I wonder if her not planning on playing Black Widow anymore after this movie factored into Disney’s decision.

“She’s already done so we’re not losing out on her future appearances if we screw her on pay”.

I agree that if her contract has been violated then she should be compensated. I also agree that top talent movies weren’t typically available for streaming until they had made their runs through the theaters. But, this doesn’t excuse her representation from specifically spelling out in the contract anything that could potentially impact tickets sold. I’m shocked that some of you appear so quick to absolve the lawyers and blame Disney. Why waste money on the lawyers if they don’t cover every angle that could negatively affect your interests?

"I'm gonna ask my lawyer if we can put a tiger attack provision in my next contract. You never know."

If it’s a possibility, he should be putting it in there without you asking as that’s what you’re paying him to do. It’s like you guys think Johansson’s contract was a half page long.
