Should employers be allowed to ask prospective employees about their criminal record?

What if, in your example, his molestation was not at the daycare? They cannot inform someone of a person's criminal history. And if it was even between jobs, how would you ever know?

On the molestation issue, since molesters' identities are a matter of public record, we can all check that portion of criminal history.

Also, I know former employers are skeptical about saying anything bad if someone calls about a reference. They have to be careful of lawsuits.
