It's not just a rabbit hole it's a very important distinction. It's the actual definition of what the 1st protects

By permanent record I mean it's now in search results. Any future employer will likely do a basic search and find it. He will have to answer for why he felt the need to hurl insults at someone

I had a teacher in elementary that always threatened with the "permanent record." I thought my life was over in the 2nd grade when I got sent to the principle's office.
