This whole situation brings some memories of when The movie theaters and with the inclusion of early TV by some accounts used subliminal messages to gain an unfair advantage in trade and commerces.

How is the current situation any different other than it is the people who are responsible for not only trade and commerce. But for the Full functionality of Government to be able to have undue influences using the same tactics as subliminal messaging? (I am not talking about politicians. I am speaking of special interest).

The perception being special interest already has to much of a death grip on this country's politics.

If it takes a constitutional Amendment to stop this So be it. Although it did not take a constitutional Amendment to stop subliminal messages, which could if the same reasoning afforded by this court applies then it to is protected by the first amendment.

As an FYI aside as much as anything else the entire issue of "subliminal advertising" was long ago exposed as a hoax.

More on topic while I actually understand your concerns I'd like to think you can appreciate those from the other side. A government that says who can and cannot say what they want or when they want is something to take under the most grave scrutiny. Call me cynical but to my mind any, and I mean ANY political donation is given by a "special interest". You're paying money in hopes things turn out the way you want them, that being your interest.

In the end who you vote for is still your call regardless of how much money big oil or Soros wants to spend.

The court did what the court is supposed to do - rule on the Constitutionality of the law.

They found it was not Constitutional.

Change the law, change the constitution, or change the court.

Yep. I don't necessarily like the decision, but the court made the right decision from a constitutional standpoint.

A distinctly liberal, even progressive, view of the role of the Court.

The far right frequently cites what the majority of the uneducated bubbas want the law to be as some sort of moral authority to play a role in the ultimate outcome of a pending case or issue. One of my least favorite characteristics of the radioheads and Fox-type thinkers is that we live in a pure democracy (little "d"). Really makes you wonder when that insipid Fox & Friends bunch asks for people to call or text in their vote on how the Court should rule.

What are you arguing, that "sublininal perception" exists? That is was ever used in advertising? Or, and more to the point I was addressing (that you had cited) that you think subliminal advertising had any proven efficacy?

If not the latter then the point is moot. Did you look at the links you posted?

The first link is basically one big "who's bored enough to come up with something dirty about anything" contest. (personal favorite, the Dodge Ram logo as the female reproductive system) Now all I need is a bag of chips and see if one of them looks like a famous person. Maybe I can make some money off Ebay.

2nd site. I've been to that site before and it's really cool. Neat "tricks on the eyes" site but utterly useless in trying to argue subliminal advertising. Best as I can tell the other links are the same. I was very specific in stating subliminal advertising.

I agree with this. The current composition of the Court believes in a broader view of corporate First Amendment rights. Its not that complicated.





You're right - this is all about Fox News :blink:

With liberals it always blame Fox and demonize corporations.


I used them as an example only because they a) generally are going to endorse a view of the public policy side of this issue that is consistent with business interests (which is different from the legal issues); and, b) their audience I think is more interested in the issue from the perspective of it being a win for the conservative interests rather than the long term social, economic, and political consequences of it.

What I am saying is that the Court is the Court. There is a legitimate debate to be had over whether and to what extent corporations have these rights. This Court has a borader view than previous Courts, and that's fine.

At the same time, those who THINK they are pleased with the result do not understand, I suspect, the consequences of it. Which is fine. Its often that way.
