Tennesse Titans, USC Trojans settle lawsuit over Lane Kiffin's hiring of Kennedy Pola - ESPN Los Angeles

NASHVILLE, Tenn. -- The Tennessee Titans have settled their lawsuit with the University of Southern California over Trojans coach Lane Kiffin's hiring away an assistant coach just before training camp last July.

The Titans and USC announced Wednesday in a joint statement that settlement terms are private but called it an "amicable" resolution. The lawsuit is expected to be dismissed in a few weeks.

The team sued July 26, a couple days after Kiffin poached running backs coach Kennedy Pola off the Titans' coaching staff a week before Tennessee opened camp.

Then-Titans coach Jeff Fisher, a USC alumnus, had fired Earnest Byner to hire Pola last offseason and said Kiffin didn't make the customary courtesy call to alert the team of his intentions.

The Titans' lawsuit accused USC and Kiffin of using "improper means" to induce Pola to breach his contract with the NFL team. But USC and Kiffin offered Pola better job security than the Titans because his NFL contract ran to Feb. 14, 2011, though the team later extended their assistants' deals through 2012.

Tennessee charged that Pola needed written permission from the team president and general counsel because verbal consent wasn't adequate, which both Southern California and Kiffin knew about through Pola. Fisher also criticized Kiffin's professionalism to a newspaper reporter.

Losing Pola forced Fisher to swap up his staff, but the Titans couldn't fill the spot before the 2010 season. Tennessee went 6-10, and Fisher left the team in late January.

Actually a settlement means that neither Kiffin nor the Grandstanding Trash Heap of an NFL Franchise wins
Who's Kennedy Pola working for now? Kiffin walked right into Mullet City and took one of their coaches. Pola decided USC was a better job than working for the Titans. When a PAC 10 coach punks an NFL franchise like that, especially when said franchise makes fools of themselves by suing the PAC 10 coach, it's pretty obvious who the winner is.

So are you saying it would have been a win for the Titans if he was made to go back and coach here? And how did Kiffin punk a franchise?

Coaches go back & forth from pro to college all the time. It doesn't mean they "punked" a team out. UT has a few on their coaching staff from the pro level.

USC and Kiffin didn't agree to settle unless they knew they did something wrong. Kiffy just went about it like a spoiled brat & behind backs as usual. I would reserve judgement on who is actually the winner until we know the $$$ of the settement.

Yep I guess Will Muschamp punked the Chiefs as well. And I'm sure Kennedy Pola thought USC was the better job. It probably had nothing to do with him getting more money (and a better title) or going back to where he is from and previously coached at. Hat loves Kiffin and hates the Titans so it's not a surprising reaction on his part.

The winner is Lane Kiffin. The hicks and rubes that run the Titans tried to curry favor with the hicks and rubes who root for them by going after Kiffin legally. All they got for their troubles was yet another public example of why they are the trailer park of the NFL. Kiffin spit in their face and laughed at the contract they had Pola signed to. All Adams and his merry band of imbeciles got is a meaningless piece of paper. When you set out to embarrass someone and all you get is an "amicable" settlement, you got punked.

You are ignoring the facts. You don't know the amount of the settlement. Next time I'll type slower.

USC wouldn't have settled the lawsuit if the contract wasn't violated. USC didn't want anymore negative publicity concerning Lane. It was made worse that he did this to a famous USC alum that was still very supportive of the program at the time. It won't be the last time someone goes after Daddy's boy legally either.

Great point, Clarence Darrow. I'll defer to your obviously vast knowledge of the legal process.

I'm sure the Titans passed on the home run PR shot of waiving a judgment against Lane Kiffin on the courthouse steps. It has nothing to do with the settelment giving them not a damn thing of substance.

The Substance = the amount of judgement. Do you know that if so post it.

I'm sure USC would've been thrilled with a prolonged legal battle against an oil man with pockets even deeper than you great posting skills.

There was going to be nothing prolonged about it. The Titans were going to be fortunate to avoid losing a summary judgment hearing. Of course, given your legal expertise, you knew that. The Titans saved face with a private, "amicable" settlement. Kiffin and USC let them keep the miniscule amount of dignity that franchise has left. The claim was frivolous from the start. By keeping it private, the Titans can let the Skoal dippers who root for them hold on to the fantasy that they actually got something out of that fool's errand.

Really having a hard time understanding how a defendant (USC/Kiffin) settling a lawsuit with the plaintiff (Titans) amounts to a victory for the defendant (USC/Kiffin) without any more knowledge. Apparently the defendant (USC/Kiffin) figured they had something to lose, whether it is legal expenses or damages.

What's the judgement $$$ amount again? I missed it in your above post.

Titans would've dropped the lawsuit if they thought they were going to lose. I don't care what your opinion of the Titan fans are but please don't drag fine Skoal products into this.

I love the assumption that it was Kiffin and USC who initiated the settlement. The Titans were the plaintiff. They had no case. They approach the defendants and say "Alright, here's the deal. We're going to dismiss our suit if you agree not to poach any more of our coaches for a specified period. Everybody pays their own legal fees. What do you think?" USC and Kiffin look at the second raters and rejects on the Titans staff and say "Sure, especially if it means we don't have to come to your shathole city for formal entry of the agreement." The settlement isn't even going to be a judgment. Kiffin and USC can violate the agreement if they choose without fear of being in contempt of a Court's order.
