Shane Dorrill, with the Office of University Relations, says records show Updyke has no connection with UA. Dorrill says Updyke was never a student, has never taken a class and was never a University of Alabama season ticket holder for any sport.

This article indicates it's 1st degree criminal mischief, which is I believe a class D felony. 2-7 years depending on the state. That doesn't seem like much to me in this case. And I may be incorrect on this one. I am not very familiar with legalities.

I didn't read the article closely enough. It alludes to 1-10 years and maybe that's the parameters for this offense in 'Bama. In this case it's more than just a "couple of trees" from my perspective. These were of historic significance to the university. Don't get me wrong. I would love to see Auburn get crippled from the NCAA investigation. I do not care much for anything 'Bama wise from a competitive standpoint. What this dude did was just plain wrong, and he should sit in a cell from where he can view the trees for the rest of his natural life. Just my opinion.

I agree with you, but the law is the law, and just because the trees "mean more" to Auburn, it doesnt change the law or punishment. I have been hearing that there could be some possible federal charges due to the improper use of the hazmat involved.

Feds are involved. I suspect more charges will be filed.
 
I seriously doubt it. What he did is the textbook definition of criminal mischief.

It is my understanding that it would have been had he gone to Home Depot and purchased Roundup. But the fact he used a federally controlled substance will bite him in the ass.
