From A Legal Perspective, Mueller’s Investigation is Dead. Here’s Why

Like a headless turkey running around in circles, Special Counsel Robert Mueller’s anti-Trump investigation is dead, even if he does not yet realize it. While his investigation stumbles onward, with life support provided by the biased media, from a legal perspective the viability of any criminal case that Mueller could possibly bring has been effectively gutted thanks to the news (suppressed for months by Mueller’s team) that the FBI’s “key agent” in both the Russia investigation and the Clinton email probe was an ardent Hillary supporter with an anti-Trump bias.

Under federal law, a prosecutor is required “to disclose exculpatory and impeachment information to criminal defendants and to seek a just result in every case.” Specifically, pursuant to Giglio v. United States, prosecutors are obligated to provide defendants with impeachment evidence, which includes, according to the DOJ’s guidelines, evidence of a witness’s biases, “[a]nimosity toward defendant,” or “[a]nimosity toward a group of which the defendant is a member or with which the defendant is affiliated.”



As a result, in any prosecution brought by Mueller against a Republican target, defense counsel would be entitled under the Constitution to all evidence in the government’s possession relevant to exploring the apparent biases of FBI agent Peter Strzok and his animosity toward Trump and the Republican Party. This, in and of itself, could be a case-killer because it is very unlikely that Mueller or the DOJ would want defense counsel poring through all the records and documents, emails, and texts in the DOJ’s and Strzok’s possession revealing the agent’s biases since this could fatally undermine any other cases or investigations the agent has worked on—such as the FBI’s decision to recommend charging General Flynn with lying to federal agents even though Hillary Clinton’s besties, Cheryl Mills and Huma Abedin, were given a free pass despite apparently doing the same thing.


Significantly, the fatal damage done to Mueller’s anti-Trump investigation does not only rest in the fact that defense counsel will be able to conduct an unlubricated prostate examination on the FBI’s key agent at trial. Instead, the real reason why Mueller will not risk a criminal trial is the lasting damage that would be done to the FBI’s reputation by having Strzok’s baggage brought into the daylight.

Where does The Daily Caller get off calling anyone else biased? That's like Sean Hannity calling CNN biased. They have no credibility to accuse anyone else of bias. There is not a shred of objectivity anywhere in this mess right down to the hyperbolic language used. The agenda is clear.

The Mueller investigation has led to a felony conviction against a former National Security Adviser and Trump campaign official who is now cooperating with the investigation. In light of that development, it's no longer politically feasible for Trump to fire Mueller.

Speculation on my part but Mueller is probably how they obtained the email and in no way was going to give them anything that could compromise the investigation. Basically throwing them perjury bait.
 
I know where you are going with this and that is fair. It could have been an inside job from that Pakistani Aman. But I have not seen that the FBI has asserted that.

Aside from arresting him, bringing his wife and maybe other family back from Pakistan; and continuously stating that Hilary nor the DNC were ever "hacked"; yeah they have done nothing.

There is that assertion that the FBI Is "continuously stating that Hillary nor the DNC were ever "hacked"" again. Where are you getting that?

Hillary and the FBI are asserting that about her server but I don't think that is the case for the DNC and FBI. I could have missed that thought.

FBI wouldn't know with the DNC, they still, last I saw/read, haven't turned over their harddrives.

Help, help, we have been robbed. No FBI, you can't come in an investigate the scene of the crime.

The question will be, will Trump jr. and any of the others deny that they accessed the Wikileaks material, but then there be some sort of objective proof that they in fact did. That will equal a perjury charge and flip them as against Trump.

I think they could get them for an attempt to access the secret site. Router logs and dns lookups traced back. Forensic evidence which has already been collected otherwise we would not know about the newest email.

CNN originally reported the email was released September 4 -- 10 days earlier -- based on accounts from two sources who had seen the email. The new details appear to show that the sender was relying on publicly available information. The new information indicates that the communication is less significant than CNN initially reported.
After this story was published, The Washington Post obtained a copy of the email Friday afternoon and reported that the email urged Trump and his campaign to download archives that WikiLeaks had made public a day earlier. The story suggested that the individual may simply have been trying to flag the campaign to already public documents.
NN has now obtained a copy of the email, which lists September 14 as the date sent and contains a decryption key that matches what WikiLeaks had tweeted out the day before.

So we had the lady from Veritas with the fake claim of abuse by Moore, trying to bait the Post into reporting her false story, so that Veritas could then yank the rug out from the Post and try to use that to suggest that the prior accusers are lying.

Then we've had this and the ABC reporter who got information about the timing of a Trump request to Flynn to contact the Russians.

There seems to be a pattern here of the right planting false or exaggerated stories as a trojan horse they can then blow up later, to give the impression that the reporters are all biased.

Reporters from all of the main stream media need to be on the lookout for right wingers trying to use this gimmick, and like the Post with the faked Veritas story, they need to turn the tables on them when it happens, and expose it.

It is really sad that MSNBC now consistently beats CNN in the TV ratings.

CNN's so called journalism sucks.

I have a Leftist next door neighbor who is a musician, and he told me he stopped watching CNN because of their constant RUSSIA coverage.
