and now they have taken the severability out of the bill that is in front of the SCOTUS
If the individual mandate is unconstitutional can the rest of the bill be implemented as congress intended. The thing is, the bill was so long and included so many provisions completed unrelated to the individual mandate: the black lung act and Indian healthcare, etc. etc.
I understand the issues on severability. I thought Scalia's quip about the 8th amendment and adjudicating severability was funny. I just didn't follow TTV's statement. I did not know who the 'they' was or exactly what bill he was referring to. I thought everything was still in play. I was just confused about what he meant.
The law would still stand in all circuits. In the 11th, the appeals court upheld Vinson saying that the mandate is unconstitutional, but ruled that the mandate was severable and that the rest of the law still stood.
