I agree that EBT cards are used incorrectly, however, in this case the EBT user could buy whatever he wanted with the cash part of the card.
You hire her for the job over the cat that fired her and the EBT user was not allowed to purchase the cigs, welcome BIG lawsuit.

who's going to sue? practically speaking, the suit is a loser and bringing to light an issue that doesn't want the light of day. And who is going to sue on what grounds? People regularly choose not to take particular types of payments and they aren't sued over it.

And, her personal stand resulted in sacrificing her job. Kudos to her for that; I would still fire her were I running a business that revolved around selling as much as possible to whomever can produce legal tender. EBT is legal tender and can be used in such transactions.

Let me know when you track this fired clerk down and offer her a job.

And your valuing that incremental revenue over what's right is why your point of view sucks.

BPV, have you fell completly off the deep end?

I do not agree with it but the cash that is loaded on an EBT is legal government tender. It is CASH and can be used to purchase anything legal.

Private business has the right to refuse service for any reason that is not discriminatory. Like "no shirt, no shoes, no service" or refusing to take checks or credit cards. While it may be legal to accept EBT for cigs and alcohol if the store chooses to not accept that form of payment they are allowed to refuse service.

I realize that, but in the case in question the store was not refusing to accept payment. The cashier was refusing to sell the guy cigs because of her political beliefs, thus the store manager stepped in and sold the guy his cigs.

The point is it is troubling that things like cigs can be purchased with tax dollars by people who couldn't otherwise afford it.

The rest of this crap about what should happen to the store clerk is fluff. I get that may have been the point of the article, but the premise underlying why she may have held said political stand is still prefectly valid.

The state should be sued for allowing the tax dollars of people who work to buy cigarettes for people who free load off hand outs when their ass should be working.

I am fine with the Gov giving a helping hand to people for a reasonable amount of time.
A helping hand is not the case. There are many people who have been on welfare 20+ years. This is wrong.

My understanding is that in Tennessee the cash part on the card comes from the families first program which supplies the mother with a small amout of cash per month to buy necessities because the childrens father does not pay child support. It kinda like they get the Families First funds in lieu of child support and the father is to be charged back for this.

It like my daddy taught me a long time ago, you can't get blood from a turnip. There are way too many dead beat dads in this world.

There are plenty of dead beat dads but I don't think that is the root cause. There are plenty of dead beat women that are able to work but would rather ride the gravy train. A lot of cases they are shacked up with other dead beat men.

The mother receive the cash allowance on the EBT card because they do not receive child support.
If that is the case, yes the money loaded on an EBT card is 100% due to a deadbeat dad/mom not paying his/her child support.

Now I may understand the law wrong.

I do agree there are many deadbeat woman that are able to work that choose to live off the government.

I wasn't disagreeing with what you were saying about the law. I was saying that dead beat dads aren't the reason a lot of women are receiving government assistance. If the government wants to give them the child support that the dead beat isn't doing then they need to find another way to do it.

no question and further, can you imagine some liberal outfit trying to push this hard in a lawsuit? There is no way someone is going to be sued over this issue.

of course there is in a litigious society and where there is big cash to be found. Attorneys in droves look for an excuse to chase the cash.

Here, you've got a c-store owner, an issue the gov't wants to avoid and a plaintiff with no money. Awful scenario for a lawsuit.

Agree with most of what you're saying, but the plaintiff might have money. He'd be stupid to let the govt find out about it, but there are people in the welfare system who have money they don't report. Street-level drug dealers come to mind.

The irony of all this is we're buying his cigarettes which could lead to lung cancer which could cost us even more to treat his dumb ass. Sad how much of a welfare state this country has become.

Today I got stuck in line behind a guy arguing with the clerk about whether he could spend the last .45 of his card on M&Ms, which apparently you can't. The guy was clearly drunk. He then proceeds to pull out a wad of cash and buy $35 worth lottery tickets. Then he walks out and gets in the passenger seat of the car and waits. As I'm pumping my gas another car pulls up beside. They make some sort of exchange and both cars pull off.

Either way just made me think if this thread.
