I hope her and her family don't have to go thru that again. News this morning saying it would be nearly impossible for Italy to force her back for ANYTHING.

it seems the prosecution can also appeal in Italy. She was acquitted and another is serving time for the murder. She should tell them to stick it and just stay out of Europe

Exactly. This double jeopardy crap just blows my mind. No new evidence, just the prosecutor complaining because he lost/doesn't accept judges decision.

I can't believe it's been since Fall of 2011 since she was released. Seems like yesterday.

So now that she has been issued a retrial, will AK be required to return to Italy? Or will she be able to just stick out her retrial in the US? Will extradition be an issue? Not sure of the laws here. Anyone know?

I haven't read anything about the retrial, but what's the circumstances? Does the prosecution just get a "do-over"?

Yep - my understanding is she was acquitted but in Italy the prosecution can also appeal. Italian Supreme Court found in favor of the prosecution so a retrial is ordered.

It appears she doesn't have to attend the trial (why would you since that puts you back on Italian soil).

She can fight extradition (if found guilty) and Italy would have to make a big stink about it - questionable if they would do so given amount of tourism from US.

However, I believe the warrant for her arrest would be through Interpol so any country that is part of Interpol might bust her and send her to Italy. So as PJ says - stay the hell out of Europe.

I don't think there is any chance she was guilty. Reading up on the prosecutor yesterday he should be behind bars.

I didn't follow the case closely and don't know about her guilt or innocence but from what I did read, there is no way that the 'evidence' indicated beyond reasonable doubt that she did it. Thus, by the US standards, she would be not guilty.

What I've read just makes me think Italy's justice system is slimier than ours. It's been a witch hunt.

Not that up to date on the issue but I'm sure the US and Italy has some sort of extradition agreement in place. That said, will the Italian government really want to make an official request with all the crap going on right now? I doubt it.

From what I heard there was definitely some sort of orgy/Ménage à trois going on and someone decided to bring a knife into the mix. Don't ever let a girl tie you up and if she introduces a gun or some sharp object during sex, run.

We do have an agreement but we didn't like the way it was handled to begin with so even if they requested it wouldn't happen.

Verdict should be out today, and from what World News Now says, she'll likely be tried again if she's found not guilty.

I read an article about her today. So you are saying if she's found not guilty she will likely be tried yet again even though this is the third trial already?

They are making their county look ridiculous

Making themselves look like a 3rd world country. Has to make you pause about planning a visit. We were actually thinking about visiting this summer while our son is over there working.

I wouldent use the Italian legal system to prove that our system is the best. That's like comparing a Bentley to a yugo. You gotta compare a Bentley to a rolls.
