An 8 minute video of a guy with his knee on a guys neck and him saying he can't breathe doesn't require a lot of rebuttal. He was alive, cop pins his neck down, man says he can't breathe, minutes later he's dead. I'm not the sharpest tool in the shed sometimes, but I can follow this scenario.

And 3rd degree murder would have fit the bill. The cop is an a$$hole and deserves to be prosecuted, there is zero doubt about that. However for 1st and 2nd degree murder you have to prove it was a planned, thought out murder and thats going to be extremely hard to prove.

I didn't know I argued for any particular degree of murder. To be honest the guy will either kill himself in prison or some POS will kill him before then. No matter what he has a death sentence.

Best guess is it’s because the charge has to go through the grand jury. I don’t think they could make probable cause on the premeditation for 1st.

Was just discussing this in the other thread. While I think third degree is the more appropriate charge, second degree is not as outrageous as people think.

In cases of second degree murder, can't you get around intent if you can prove depraved indifference, or if the reasonable possibility of death was known?

Someone posted earlier. In MN for second degree they just need to prove felony assault. I will admit it could happen but I'm not sure its like. Just because how can it be assualt if he was doing something he was trained to do?

I imagine that’s the case in MN for 1st. Their statutes for murder are different.

In TN 2nd degree murder is a “knowing” killing which always seemed to me like a way to avoid confusion because I don’t see much practical difference between “knowing“ and “intentional.” We basically just drop the premeditation and call it something different.

I think a conviction is hard to achieve, here. Police cases are hard because they get to talk about how they were trained and how their job is and how people like Floyd lie to them all the time and then assault them when they let their guard down. They tried a cop here for assault on a Hispanic guy a few years ago and the video was brutal. He was bouncing the dude’s head off the ground over and over and just totally wrecked his face. I didn’t watch the trial but I saw the video and I thought it was one of the most offensive things I’d ever seen. Jury acquitted him within a few hours.

Now that Brees uses his rights to speak his mind and suffers consequences, that is not cool.

Jury sees Minneapolis PD has trained him it’s ok to use knee on the neck as it’s manual says, Floyd swallows bag of fentanyl laced meth when police shows up on call then his heart gives out from the drugs. It’s going to be hard to prove without a doubt the officer is guilty of 2nd degree murder

I would argue the fentanyl would affect his respiratory drive before the methamphetamine affects his heart.
