Best guess is it’s because the charge has to go through the grand jury. I don’t think they could make probable cause on the premeditation for 1st.If the jury can still convict him if a lesser charge why not charge with 1st degree, appease the masses, then bank on getting a 3rd degree conviction? Honest question, because I don’t know.

Someone posted earlier. In MN for second degree they just need to prove felony assault. I will admit it could happen but I'm not sure its like. Just because how can it be assualt if he was doing something he was trained to do?Got ya, in Virginia you have to prove intent and that it was premeditated

Now that Brees uses his rights to speak his mind and suffers consequences, that is not cool.
