Berman, US Attorney for SDNY, forced out

Read Barr’s answer to that answer above with regards to pending cases and apply some more baby powder Cletus.

since you’re slow here I’ll spell it out for you.

Barr released this statement in reply to Berman:
“Your statement also wrongly implies that your continued tenure in the office is necessary to ensure that cases now pending in the Southern District of New York are handled appropriately. This is obviously false. I fully expect that the office will continue to handle all cases in the normal course and pursuant to the Department’s applicable standards, policies, and guidance.”

Barr can put out any statement that he wants... the objective was revealed as soon as Trump announced that he would nominate Jay Clayton as a replacement for Berman. There is no way that nomination would ever meet the approval of the home state Senators, as is precedent.

Nobody other than a radical left anti Trump appointment would meet the home state Senator’s approval. It’s Trump’s choice. The Senate can confirm or not. No courtesy approval ask is required and I’d guess in the continual inflamed state going forward that gets waived even more.

It's not required but it does stand as precedent. Sen. Lindsey Graham of the Senate Judiciary Committee, has gone on record saying that it is a precedent that he will follow for Berman's replacement. Sen. Chuck Schumer has already said that Jay Clayton won't cut it.

List of federal judges appointed by Bill Clinton

Following is a list of all Article III United States federal judges appointed by President Bill Clintonduring his presidency.[1] In total Clinton appointed 378 Article III federal judges, including two Justices to the Supreme Court of the United States, 66 judges to the United States Courts of Appeals, 305 judges to the United States district courts and 5 judges to the United States Court of International Trade.
Additionally, 8 Article I federal judge appointments are listed, including 1 judge to the United States Court of Appeals for Veterans Claims and 7 judges to the United States Tax Court. This is not a complete list of Clinton's Article I federal judge appointments.
A president can do what he wants to right? Take a 👀 at this.

Schumer can vote to not approve so can Gillinbrand then.

It isn’t precedent it’s courtesy. Of which Schumer deserves none.

You are missing the point. Sen. Lindsey Graham, Chairman of the Senate Judiciary Committee, has said that a nomination for Berman's replacement won't go forward without both of the home state Senators from New York, Sen. Chuck Schumer and Sen. Kirsten Gillibrand, signing off on the nominee... and yes, it is precedent.

Oh I know he said that. You’re ignoring the point that the blue slip is a courtesy and not a requirement.

A courtesy is just a courtesy, not a requirement and damn sure doesn’t meet precedent level. Plus that precedent was already bypassed in CA on recent appointments

@NorthDallas40

I said that it was not required in post #130 of this thread (only 4 posts above your last post) and it does serve as a precedent.

So they are saying that they remove an experienced U.S. Attorney, for a person with ZERO prosecutor experience because he wants to move back to Manhattan?

Sounds perfectly legit. I'm sure obstructing the investigation into Rudy Giuliani's financial dealings in the Ukraine had nothing to do with it. There is a reason this was done as a Friday night news dump, the day before a planned campaign rally.

And I’ve also said the precedent has already recently been bypassed in Ninth Circuit appointments in CA.

You’re trying to give the blue slip more weight than it has. Which is none.

Obviously, the person who matters the most, the Chairman of the Senate Judiciary Committee, Sen. Lindsey Graham, is giving considerable weight to the "blue slip rule" and, Sen. Graham has said that he will not let the nomination of Jay Clayton move forward without the two home state Senators from New York, Sen. Chuck Schumer and Sen. Kirsten Gillibrand, signing off on the nomination of Geoffrey Berman's replacement. Sen. Chuck Schumer has already said "No" on Jay Clayton, as he should. Jay Clayton has no experience as a prosecutor in any capacity. That was a ridiculous nomination. It is also transparent in it's attempt to thwart an investigation into a Trump ally and former attorney, Rudy Giuliani, whose conduct played a key role in Trump's impeachment.

And for what it's worth, in spite of this one display of integrity, I still hate Sen. Lindsey Graham. He is weak and feckless.

I get the sense you feel that something more is a afoot here than homesickness.

Trump made a spectacle of the situation by announcing that Jay Clayton of the SEC would be nominated to replace Berman. Clayton is a Trump ally with no prior experience as a prosecutor. There is no way that the home state Senators (Schumer and Gillibrand) would approve of him. However, as previously pointed out, Sen. Lindsey Graham, Chairman of the Judiciary Committee, has said that he will follow precedent here, and he will not proceed with the nomination of a replacement for Berman unless the Senators from New York, Schumer and Gillibrand, have signed off on the nominee. That will never happen for Clayton. It's common knowledge that Berman was investigating Rudy Giuliani for his financial dealings involving the Ukraine. It should be apparent to all, that Trump wants that investigation stopped.

Barr publicly kept space between himself and Giuliani's work for Trump, but now he's going to throw it all away for him? He clearly stated any investigations will continue unabated under interim Strauss or whomever is confirmed.

It should be apparent this is another nutty conspiracy theory that was DOA.

Yeah, another nutty theory that originated from a Friday night news dump with an announcement that Trump would be nominating someone with no previous experience as a prosecutor to be the U.S. Attorney for the SDNY. Attorney General Barr's glowing account of Berman's work as a prosecutor only adds to the questions over why he was fired.

Might be a previous precedent but not a requirement.

And Barr has already had to walk that offer to Craig Carpenito back, and appoint Audrey Strauss, as the temporary replacement to Berman. This was unprofessional. Barr does need to explain himself.

And Audrey Strauss has given to numerous Dems over the years. This is a faceplant for Barr.
