The NCAA still has a ban on paying players and if an NIL specifies a particular school then that would probably hold up in court when challenged. However let's use this potential deal with Nico as an example. ALL SPECULATIVE HERE FOR EXAMPLE PURPOSES ONLY-

Spyre signs Nico to a big NLI contract contingent on that contract having certain "deliverables". Now let's say that among those deliverables is the requirement that the NIL provide a return value within the state of Tennessee.... or even within a few counties surrounding K'ville. Obviously the "customers" on the other side of Spyre aren't looking for someone whose NIL has limited value with their customers... who happen to reside in Tennessee or even in a more gray area... happen to be fans of Vol football. If the NIL does NOT provide that value to some car lot or t-shirt company or whatever that services TN and/or Vol fans... then Spyre does not get paid. If the NIL of the athlete has no value to Spyre's customers then there's no reason they should have to pay.
